Customs and Intellectual Property Rights

حمايت از صاحبان ابداعات و خلاقيت‌هاي فكري كه از آن به حقوق مالكيت فكري ياد مي‌شود به‌عنوان يك ضرورت در زمينه‌هاي فناوري و هنري از 140 سال قبل شروع و با پيشرفت صنعت و توسعه تجارت به انواع و اشكال آن و خطرهايي كه نقض اين حقوق ايجاد مي‌كند افزوده شد، به‌طوري‌كه هم‌اكنون علاوه‌بر قوانين داخلي كشورها، يك سازمان بين‌المللي به نام سازمان جهاني مالكيت فكري (وايپو) (زيرمجموعه سازمان ملل متحد) با 24 كنوانسيون بين‌المللي تحت پوشش و يك موافقت‌نامه مهم بين‌المللي در چارچوب سازمان جهاني تجارت به نام موافقت‌نامه جنبه‌هاي تجاري مالكيت فكري براي تبيين موارد و اشكال و نيز مبارزه با نقض يا ناقضين اين حقوق ايجاد شده است. اين مقاله به‌صورت يك مطالعه توصيفي تهيه و با مراجعه به سايت‌هاي نشريه سازمان جهاني گمرك، سازمان جهاني مالكيت فكري، سازمان جهاني تجارت، پليس بين‌المللي، قانون امور گمركي (مصوب 1350) و تجربيات شخصي در طول دوره خدمت در گمرك مطالب استخراج و با هدف نشان دادن گستردگي بالاي موضوع، دارا بودن جوانب مختلف و تبيين آن و ذكر ريوس مطالب براي آموزش و مطالعات تكميلي، جمع‌بندي و پيشنهادهايي براي افزودن موادي به قانون امور گمركي ارايه شده است. اين مطالعه نشان مي‌دهد گرچه كشور ما براي حمايت از حقوق مالكيت فكري قانون ثبت مارك تجاري و اختراعات را در سال 1310 و همچنين قانون حمايت از مولفين، مصنفين و حقوق هنرمندان را در سال 1349 به تصويب رسانيد و علاوه‌بر آن در آذر ماه 1338 به كنوانسيون پاريس و در فروردين ماه 1381 به كنوانسيون سازمان جهاني مالكيت فكري ملحق شد، ولي عملاً بهاي لازم براي مبارزه با اين پديده خطرناك به‌ويژه در قانون امور گمركي با توجه به اينكه نقض اين حقوق به‌ هنگام تردد كالا در مرزها و در گمركات قابل تشخيص و اقدام لازم است، داده نشده و بنابراين بدون ورود به ماهيت كنوانسيون‌هاي مربوطه پيشنهادهايي ازنظر شكلي براي افزودن موادي به قانون امور گمركي (با اقتباس از مدل قانوني نشريه سازمان جهاني گمرك) داده شد.

Supporting innovations and intellectual creativities owners that called "Intellectual Property Rights" as a necessity in the fields of technology and art began 140 years ago and with industry and business development, the more its types and forms and the more risks of violating the rights so now in addition to civil laws of countries, an international organization called "WIPD (World Intellectual Property Database-subset of the United Nations) has been created which have 24 International Convention Coverage and an important international agreements within the WTO called TRIPS (Trade-Related aspects of International Property Rights) to explain the cases and forms and to combat violations or violators of these rights. The paper is a descriptive study and has been written based on narrative review and visiting the WCO, WIPO, WTO, INTERPOL sites and according to Customs Act (enacted 1971), and personal experiences during service in Customs Department, issues have been gathered and with the intention of demonstrating the scope of the issue with various aspects and its explanation, the outline for training and complementary studies, conclusion and recommendations for adding Articles to the Customs Act has been presented. This study shows that although our country approved "Registered Trademarks and Patents Act" to support intellectual property rights in 1931 and ratified "Copyright Act" in 1970 and in addition, acceded to "Paris Convention" in December 1959 and "WIPO Convention" in March 2002. but actually this dangerous phenomenon has been neglected especially by "Customs Act" regarding the violation of these rights when crossing goods from borders and customs, necessary actions should be taken and therefore regardless the nature of the relevant conventions, recommendations on adding some Articles to Customs Act (mostly borrowed from WCO Model) have been taken procedurally.
