بررسي جهان‌شمولي اعلاميه جهاني حقوق بشر از منظر نقد مباني اومانيستي آن

Studying on Universality of Universal Declaration of Human Rights from the Perspective of Critique of Humanistic Foundations

حقوق بشر غربي به معناي حقوقي است كه انسان‌ها صرفاً به دليل انسان‌بودن از آن برخوردارند و سرشت ديني و الاهي بشر، كه ويژگي «از خدايي» بودن و «به سوي خدا» شدن و «استعداد براي نيل به كمال شايسته انساني» داشتن را به همراه دارد، در اين حقوق ناديده انگاشته شده است. اين حقوق با محوريت تفكر ليبرالي، الحادگرايي، فردگرايي، و با ناديده‌گرفتن مبدا و منتهاي جهان و هستي، غفلت از تكاليف، و به ويژه فرماليسم، منظومه فكري بسته‌اي را شكل داده است كه هر آن‌چه غير غربي خوانده شود از اين منظومه طرد مي‌شود و ديگر به آن حقوق بشر اطلاق نمي‌شود و به جاي توجه به انديشه تعالي بشر، هويت واقعي انسان را ناديده مي‌گيرد و در‌نتيجه، هرگونه تفاوت، مانند تفاوت عقيدتي، سياسي، فرهنگي، نژادي، را با چالش جدي مواجه مي‌كند؛ زيرا هر‌يك از اين تفاوت‌ها سبب شكل‌گيري هويتي متفاوت از ديگري مي‌شود. در‌حقيقت، حقوق بشر غربي نه در مرحله عملي جهان‌شمول است و نه در مرحله نظري؛ چرا كه نه توانسته است، در طي تاريخِ تكوين خود، اجماع جهاني را همراه كند يا دستِ كم قدر مشترك فرهنگ‌ها و تمدن‌ها را در‌بر بگيرد و نه اين‌كه در قبال فرهنگ‌ها و اديان و تمدن‌ها بي‌طرفي اتخاذ كند و لعاب اومانيستي بودن را از خود بزدايد و مبتني‌بر نيازهاي ابتدايي و فطري بشر تدوين شود. اين مقاله بر آن است تا از طريق نقد مباني اومانيستي حقوق بشر غربي نمايان سازد كه پايه اين حقوق مبتني بر اومانيسم الحادي است؛ در‌نتيجه، ادعاي جهان‌شمولي آن بي‌بنياد است.

Western human rights have been based on merely "being mankind" and humanʹs divine nature and oneʹs talent to achieve worthy evolution have been ignored. In this viewpoint of human rights, concentrating the view on liberal thought, atheism, individualism and formalism and ignoring the beginning and the destination of the existence and the universe and then ignoring duties and personalities, what is not western is not considered as human rights and rather than paying attention to human sublimation, real human identity is ignored and therefore any ideological, political, cultural and racial differences will be changed to serious challenges. Because which of them, on this viewpoint, leads to formation of a new identity. Really western human rights discourse has not been universal both theoretically and practically. Neither it has been successful to achieve universal consensus or at least to involve a common area of different cultures and civilizations nor it could have been impartial than different cultures, religions and civilizations, kept out humanism and codified rights based on primary and innate requirements. Criticizing the bases of humanist western human rights discourse, this paper is supposed to explain that these rights have been based on atheist humanism and therefore cannot be universal.
