حق سلامت جنين از منظر اخلاق، فقه و حقوق پزشكي

The health right of embryo in new medical research from view point of ethics, jurisprudence and Iran law

جنين، حداقل به‌عنوان انساني بالقوه -كه قابليت و توانايي تبديل به يك انسان كامل را دارد- شايسته تكريم و احترام و داراي حقوقي از جمله «حق حيات» و «حق سلامت» است. حمايت از حقوق جنين، منحصر به حمايت از حق حيات از طريق ممنوعيت سقط جنين و يا ساير اعمالي كه منجر به سلب حيات از آن مي‌شود، نيست؛ بلكه حمايت از حق سلامت جنين را نيز شامل مي‌شود. يعني ممنوع شمردن هر گونه رفتاري كه موجب آسيب و صدمه به جسم و روان جنين شده و به عنوان يك عامل خطر نسبت به سلامت او محسوب مي‌شود و فراهم ساختن امكانات و شرايطي كه جنين در پناه آن، چه در دوران جنيني و چه در حين تولد، زندگي سالم و بري از هر گونه نقص و معلوليتي داشته باشد. يكي از اموري كه مربوط به «حق سلامت» جنين مي شود، موضوع «پژوهش‌هاي جنيني» است. منظور از پژوهش‌هاي جنيني، آزمايشاتي است كه در عالم پزشكي بر روي جنين و به مقاصد مختلفي انجام مي‌پذيرد. اين پژوهش‌ها ممكن است بر روي جنيني كه در رحم مادر قرار دارد يا جنيني كه از طريق IVF و در درون لوله‌هاي آزمايشگاهي انعقاد يافته‌ و يا جنين شبيه سازي شده با تكنيك SCNT و همچنين جنين‌ سقط شده به عمل آيد. در حالي كه ممكن است نتايج پژوهش بسيار سودمند باشد، شماري از مسايل مهم اخلاقي، فقهي و حقوقي در اين زمينه مطرح خواهد شد. در اين مقاله تلاش شده اين موضوع از منظر اخلاق، فقه و حقوق ايران مورد واكاوي قرار گيرد.

The embryo like a potential human that has the ability of becoming a perfect human, is respectable creation and has same rights such as health right and life right. Protection of fetal right is not as exclusive as life right through abortion or another action which led to death, because it includes the protection of fetus health right. It means that, the prevention of each type of treatment which disturb fetusʹs body and psych and is like a danger factor to disturb his health and provide some situation and facilities in which the embryo has a safe life without any kind of defect and disabilities during fetal period and at the birth moment. One of the important case in related to embryo’s health is the topic of "embryonic researches and investigations". The embryonic investigation includes some tests with various aims in medical word. These investigations maybe test on the embryo that is in mother womb or the embryo that is frozen and coagulated in the test pipes through IVF or the embryo that is cloning through SCNT technique. But, beside these so beneficial conclusion, there are numerous legal, jurisprudence and ethical problems which are very significant. In this article, I tried to consider this issue, from view point of ethics, jurisprudence and Iran law.
