The Role of the United Nations Security Council in the Implementation of International Criminal Justice

ارتباط شوراي امنيت با ديوان كيفري بين المللي از رابطه عميق بين عدالت و صلح حكايت دارد. از آن جايي كه جنايات تحت صلاحيت ديوان (نسل كشي، جنايت ضد بشري، جنايت جنگي و جنايت تجاوز) اصولاً در وضعيت هايي رخ مي دهد كه متضمن تهديد بر صلح، نقض صلح يا عمل تجاوزكارانه است و از اين جهت با اختيار شوراي امنيت نسبت به حفظ و اعاده صلح و امنيت بين-المللي مرتبط مي گردد، نقش شوراي امنيت در تحقق عدالت كيفري بين‏المللي امري اجتناب ناپذير مي نمايد. بر اين اساس، با تصويب اساسنامه ديوان، در موارد مختلفي به نقش شوراي امنيت در تعقيب، محاكمه و مجازات مرتكبين جرايم مشمول صلاحيت ديوان پرداخته شده كه شامل موارد ذيل است: الف) ارجاع وضعيت از جانب شوراي امنيت به دادستان ب) تسهيل و تضمين همكاري دولت‏ها با دادستان در مرحله تحقيق و تعقيب بين المللي و نيز تعليق تحقيق يا تعقيب. ج) نقش شوراي امنيت و دادستان در تعقيب جرم تجاوز. بررسي تاثير اين موارد بر تحقق عدالت كيفري بين‏المللي، موضوع مقاله حاضر است.

Relationship between the UN Security Council, the institution of international criminal justice demonstrates a deep relationship between peace and justice. Therefore by ratification of statute of international criminal court, in different cases we can see the roles of UN Security Council in prosecute, trail and punishment those who commit the crimes within the jurisdiction of international criminal court. As the goal of the present paper these roles of UN Security Council have been clarified. They include: (1)referring the case from the Security Council according to paragraph(b) of Article 13 of the Statute and investigating it by the Court’s prosecutor, (2) during the process of investigation and prosecution of international crimes, Security Council can facilitate and guarantee the cooperation between states and prosecutor and also hinder the function of prosecutor to investigate and prosecute international criminals by suspending the initiation or continuation of investigation and prosecution based on the seventh chapter of the Charter, (3) role of Security Council in prosecuting crime of aggression. Influence of these roles on the implementation of international criminal justice is under discussion in this article.
