بررسي پيوند عضو با استفاده از سلول‌هاي بنيادي با رويكردي بر نظر امام خميني(س)

چكيده: تا چندي پيش تنها درمان بيماراني كه عضوشان را از دست مي‌دادند پيوند عضو با استفاده از اعضاي مصنوعي بود كه با مشكلاتي جدي از قبيل كافي نبودن اهداكنندگان، پس زدگي، نياز به استفاده طولاني مدت از داروهاي خاص و مسايل ديگر همراه بود. طي چند دهه اخير با كشف و بكارگيري سلول‌هاي بنيادي، در درمان بيماري‌هاي لاعلاج و پيوند اعضا، بافت و سلول در جهت ترميم عضو آسيب ديده و درمان بسياري از بيماري‌هاي بدخيم و خوش خيم، در عرصه علوم پزشكي انقلاب عظيمي به وجود آمده و در جهت پيوند اعضا و بافت‌هايي مانند قلب، كبد، مغز استخوان، قرنيه و ... پيشرفت‌هايي شده است، و اين موفقيت‌ها در بيماران پيوندي همچنان ادامه دارد. مساله حرمت يا جواز استفاده از سلول‌هاي بنيادي، همچنين مالكيت انسان بر اعضا و سلول‌هاي خود و امكان يا عدم امكان خريد يا فروش اعضا و سلول‌هاي بنيادي از جمله موضوعاتي است كه موافقان و مخالفاني در حوزه‌هاي اخلاقي، مذهبي و حقوقي داشته است. اهميت پيوند عضو و درمان بيماري‌هاي لاعلاج با استفاده از اين فناوري و نجات جان يك انسان موجب شده تا علماي مذهبي و اخلاقي استفاده و حتي خريد و فروش آن را جايز بدانند. پژوهش حاضر بر آن است سلول‌هاي بنيادي را به صورت اجمالي و با روش پژوهشي ـ تحليلي از منظر فقهي ــ حقوقي و مختصري از نظر اخلاقي مورد بررسي قرار دهد. كليدواژه‌ها: سلول، بنيادي، پيوند، عضو، بافت.

Until recently the treatment of patients having lost their organs was transplantation of organ or using artificial organs that faced lot of difficulties such as shortage of donors, rejection of the transplanted organ by the body of recipient, requirement of using specific drugs for a long time, etc. The discovery and application of stem cell over the past few decades has created a great revolution in the field of treatment of incurable diseases and organ transplantation as well as benign and malignant diseases. Also great improvement has been made in the field of treatment of tissues of heart, liver, membrane, and other body organs. The issue of permissibility or impermissibility of using stem cells, man’s ownership of his or her organs, sale and purchase of organs and stem cells are among the problems that have created lengthy debates in the ethical, religious and legal fields. The significance of organ transplantation and treatment of incurable diseases with new technology and saving of a life of a human being have convinced some of the religious and ethical scholars to permit their use and even their transaction. The present paper is an attempt to study the issue of use and transaction of stem cells from jurisprudential, legal and ethical perspectives in Islam. The problem is studied through descriptive-analytical method.
