مقايسه ديدگاه‌هاي فقهي مذاهب اسلامي درباره مسووليت‌هاي حقوقي و كيفري كادر پزشكي

Islamic Religious and their view on medical staff rights, legal and criminal liability

اقدامات پزشكان در راستاي درمان بيماران نه تنها مشروعيت، بلكه ضرورت دارد و واجب كفايي است. گاهي بيمار در اثر معالجه، تلف و يا دچار ضرر مي‌شود، در آن صورت اين سوال به وجود مي‌آيد كه آيا پزشك، ضامن است يا خير. پاسخ به اين سوال نياز به بررسي موضوع از جنبه‌هاي مختلف دارد. در اين پژوهش كه موضوع از ديدگاه فقه اماميه و مذاهب چهارگانه اهل سنت به روش توصيفي تحليلي مورد بررسي قرار گرفته، چنين به دست آمده است كه نمي‌توان پزشك را به طور مطلق ضامن دانست و يا راي بر تبريه او داد؛ بلكه در صورت عدم اخذ برايت، نداشتن تخصص كافي و يا وقوع كوتاهي از او ضامن مي‌باشد؛ در غير اين صورت ضامن نيست.

Medical procedures in order to the patientsʹ treatment are legitimate, necessary and have to be done sufficiency. When the under treatment patient dies or injured, are the doctors responsible, even if he/she has enough knowledge and experiences, or there are some limitations? The question is whether or not the physicians are responsible for compensation? Addressing such kind of questions needs systematic investigations in different aspects. The present descriptive/ analytical study, aimed to compare perspectives of Islamic religious either Shiʹa or four divisions of Sunnis about juridical and legal responsibilities of medical staff. In conclusion, physicians are not either responsible or free of charge in absolute, but if they have no enough experience and knowledge, or did not pay enough attention, they are responsible, otherwise not.
