Allocation and Utilization of the Spoils (Anfal) in Iran (Case Study: Transference of Mines)

با ابلاغ قانون اجراي سياست‌هاي كلي اصل (44) و واگذاري ثروت‌هاي عمومي به بخش خصوصي سوالات جديدي در اين حوزه مطرح است. مقاله حاضر با روش كيفي و تحليلي ـ توصيفي؛ از طريق جست‌وجو در منابع و مصادر پيشين به گردآوري اطلاعات درباره ثروت‌هاي عمومي از باب انفال پرداخته و سپس با تكيه بر قواعد اصولي، فقهي و روش اجتهادي، موضوع را مورد نقد و بررسي قرار مي‌دهد. ثروت‌هاي عمومي (انفال) شامل مواردي است كه بشر در پديد آوردن آن نقشي ندارد و همان‌طور كه چيستي انفال تاسيسي نيست و شارع همان نظر عرف عقلا را دارد، در حوزه مصرف نيز شيوه عقلايي مدنظر شارع است. البته فقيه حاكم بايد با تنظيم سياست‌هاي شرعي در حوزه تعريف و مصرف، به تدوين و ارايه راهبرد بپردازد. همچنين درباره ضوابط بهره‏برداري از معادن (كه مطالعه موردي اين تحقيق است)، تطبيق بسيار كمي بين قوانين موضوعه و فقه اماميه ديده مي‏شود.

New questions have been raised after the Act of Enforcing General Principles of Article 44 of the Iranian Constitution and transference of mines to the private sector. The article collects data about the Spoils (Anfal) by a qualitative, analytical and descriptive method through searching in previous sources and resources and then reviews the topic on the basis of principles and rules of Islamic theology and jurisprudence and the Ijtihad method. The Spoils (Anfal) include things that humans have no roles in creating them. As the Spoils are among the pre-Islamic prescripts, and the legislator of Islam has accepted the customs of reasonable persons, their utilization is also based on reasonable methods. The Islamic ruling must, of course, design strategies through organizing Islamic policies on definition and utilization of the Spoils. There is very little consistency between positive laws and Imamite jurisprudence upon utilization of mines.
