نوشتار پيش رو به اين مسيله مي‌پردازد كه از آموزه‌هاي قرآن كريم مي‌توان ميان قواعد عام مسيوليت بين المللي و حقوق خاص معاهدات ارتباطي نظام واره برداشت كرد. رويكرد سيستمي كه به تازگي در پاسخ به معضل از هم‌گسستگي، چند پارگي و تكثر در حقوق بين‌الملل معاصر به ويژه در رژيم خودبسنده معاهدات، ظهور كرده و رابطه نظام‌مند ميان قواعد اوليه و ثانويه را تعريف نموده، پيشتر در قرآن بيان شده است. در اين كتاب آسماني براي صيانت از تعهدات ناشي از معاهدات كه الزاماتي اوليه را موجب مي‌گردند، اين تدبير حكيمانه پيش‌بيني شده است كه مي‌بايست تعهداتي پسين، عدالت محور و عام بر خاطي حكم شود. همچنين تناسب ميان خسارت ناشي از عهد شكني و جبران آن در قواعد ثانويه قرآني، اصلي اصيل است كه سبقت در عدالت خواهي را نشان مي‌دهد؛ از اين‌رو، نوشتار حاضر مي‌كوشد تا دو عنصر كارآمدي و دادگسترانه را با تطبيق بر رهيافت جاري حقوق بين الملل در رويكرد سيستمي اين كتاب الهي اثبات كند. كليد واژگان: قرآن، حقوق، رژيم خود بسنده (حقوق معاهدات)، نظام عام حقوق بين‌الملل، جبران خسارت، اصل تناسب.

Candidate of the Quran and Law Abstract The current article addresses the question whether or not a systematic relation exist between the Quranic teachings and the general rules of international responsibility and individual rights of treaties. The writer is of the view that the systematic approach that has recently appeared in response to the dilemma of disconnectedness, incoherence and diversity of contemporary international law particularly in the autonomous regime of treaties, had already existed in the Quran defining a systematic relation between primary and secondary rules. To protect the warranty of treaties that arise from certain obligations, the heavenly book has also predicted the wise measure that the next commitments should be just and general and include he who violates the treaties. As such, the Holy Quran approves the principle of proportionate compensation of the damages that comes out of violation of treaties. This principle can be traced back to the concept of divine justice. The present paper tries to prove the two important elements of efficiency and justice and implement them on the prevailing approach of international law and a systematic approach on this divine book.
