بررسي تطبيقي حقوق كودك در قرآن و كنوانسيون حقوق كودك

A comparative study of childrenʹs rights in the Quran and the Convention on the Rights of the Child

حقوق كودك از مهم‌ترين بحث‌ها در حوزه حقوق خانواده مي‌باشد. در همين زمينه، مكاتب گوناگون حقوقي، ديدگاه‌هاي متفاوتي ارايه داده‌اند. اين نوشتار به مقايسه ديدگاه‌هاي دو نظام حقوقي مطرح و مهم مي‌پردازد؛ يعني نظام حقوقي قرآن كه جامع‌ترين منبع هدايت بشر است و كنوانسيون حقوق كودك كه شالوده آخرين تلاش‌هاي انسان قرن بيست و يكم در عرصه بين‌الملل مي‌باشد. در اين نوشتار، بعد از بررسي جايگاه حقوق كودك و معرفي دو نظام حقوقي، به منظور بررسي تطبيقي دو نظام، تفاوت‌هاي آنها را در سه حوزه مبنايي، محتوايي و روشي يادآور شده است. پس از بررسي تطبيقي دو نظام حقوقي و ملاحظه تفاوت‌هاي آن دو، روشن مي‌شود كه حقوق كودك در قرآن از سطح فاخرتر و برتري نسبت به كنوانسيون حقوق كودك برخوردار است؛ چرا كه كنوانسيون گرچه داراي نقاط مثبت و خوبي است، اما برخي از حقوق اصلي كودك را ناديده گرفته است. كليد واژگان: قرآن، كنوانسيون حقوق كودك، كودك، حقوق.

Candidate of teaching Islamic teachings- Mashhad Firdausi University Abstract The Rights of the Child is one of the most important debates in the Family Law. Various legal schools of thought and accounts are available on the subject. The present paper studies comparatively the views of the two prominent legal systems; i.e. the Quranic legal system that constitute the most comprehensive source of guidance for the human and the convention on the Rights of the Child which is the output of humanʹs latest [21th century] efforts in the international arena. The writer in his comparative study of the two legal systems highlights the childrenʹs rights and introduces the two legal systems. Then he reminds the reader of the two schoolsʹ main differences in three basic spheres of foundation, content, and method. The conclusion he draws is that the rights of a child in the Quran is greater in quantity and quality than that of the convention on the Rights of the Child; because this convention (CRC) though covers some positive points but still overlooks some of the childrenʹs basic rights.
