Methodology of legal interpretation

يكي از انواع تفسير قرآن كريم، «تفسير فقهي» است كه فقها و مفسران شيعه و سني براي فهم احكام شرعي از قرآن كريم، از قرن‌هاي اوليه اسلام تاكنون، از اين روش استفاده كرده‌اند. در اين نوشتار، بعد از مباحث مقدمي، به ويژگي‌هاي تفسير فقهي، انواع روش هاي تفسيري، مباني و ادله اشاره شده است و به دليل اهميت اين نوع تفسير، مهم‌ترين كتاب‌هاي مربوط از قرن دوم تاكنون آورده شده و در وسع اين نوشتار، برخي آسيب‌هاي تفسير فقهي بيان شده است. كليد واژگان: قرآن، آيات الاحكام، تفسير فقهي، تفسير موضوعي، فقه القرآن.

Methodology of legal interpretation Dr. Muhammad Mahdi Karimi Niya Faculty Member of the research center of culture and thought Abstract One kind of interpretation of the Holy Quran is “Legal interpretation”. The Shiite and Sunnite jurists and exegetes from the first centuries of Islamic history onwards have applied this method to understand and derive religious rulings (requlations) from the Quran. The current paper after introductory discussions draws attention to the characteristics of legal interpretation, the kinds of exegetic methods and the foundations and arguments that favor legal interpretation. Due to the high significance of this type of interpretation, the writer has also touched the most important and relevant books from the second century onward.
