تفسير حقوقي قرآن يكي از گرايش‌هاي تفسير علمي قرآن ميباشد. اين گونه از تفسير مستلزم روششناسي است كه محور اصلي مجموعه بههم پيوسته موضوعات حقوقي ـ قرآني به شمار ميآيد. با توجه به چنين جايگاه و اهميتي، اين نوشتار درصدد تبيين آن روش ميباشد. ابتدا مفاهيم كليدي و سپس با توجه به تعريف مورد نظر از تفسير حقوقي، اهداف مشترك و متفاوت آن ارايه شده است. در ادامه، بحث مباني و اصول بنياديني كه موجوديت تفسير را تحت تاثير قرار ميدهد، بحث قلمرو كه محدوده تفسير را روشن ميكند، بحث منابع و دادههايي كه نوعي شناخت را پيرامون تفسير حقوقي در اختيار مينهد، بحث ضوابط كلي كه بايد توسط مفسر رعايت گردد، و بحث شيوه اجرا كه مراحل فعاليت مفسر براي دستيابي به آموزههاي حقوقي قرآن كريم را معين ميكند، آورده شده در پايان، به مهمترين آسيب‌هايي كه چه بسا مفسر در فرايند تفسير حقوقي قرآن كريم به آن مبتلا گردد پرداخته شده است. كليد واژگان: قرآن، روش‌شناسي، تفسير، تشريع، فقه، حقوق، تفسير حقوقي.

The methodology of legal interpretation of the Quran Dr. Muhammad Ali Rezai Isfahani Associate Professor of Al-Mustafa International University Nasir Damyati PhD Candidate of Quran and Sciences at Al-Mustafa International University Abstract The legal interpretation of the Quran is one of the fields of study in the scientific exegesis of the Quran. This type of interpretation requires methodology which forms the basic axis of a series of Qur??nic-legal interrelated topics. Given the high significance of methodology, the article tries to describe it in detail. The writer initially has a close account of the key concepts, then choses his definition of the legal interpretation and finally offers their common and distinct objectives. Afterward, he talks about the firm foundations that affect the whole existence of the exegesis. Therefore, the writer discusses the realm of exegesis and then the sources which offers him a kind of cognition on legal interpretation. Moreover, he touches those conditions and terms that the interpreter meets. In addition, he elaborates on the executive measures the interpreter takes to access legal instructions of the Holy Quran. Lastly, he points out the most important challenges an interpreter faces during his legal interpretation of the holy Quran.
