درآمدي بر نقش مجلس شوراي اسلامي در حسن اجراي سياست‌هاي كلي نظام

An Introduction to the role of Iran’s Islamic Parliament in the proper execution of the general policies

در جامعه نظام‌مند و داراي چارچوب‌هاي قانوني مشخص، هريك از قوا، دستگاه‌ها و مقامات‌ بايد وظايف و اختيارات خود را در راستاي اجراي اهداف و آرمان‌هاي قانون اساسي به عنوان عالي ترين سند مشترك جامعه مدني‌ اعمال نمايند. در واقع لزوم حركت منسجم كليه قواي حكومتي در مسيري هماهنگ و در جهت نيل به نقطه آرماني ترسيم شده امري كاملاً بديهي و ضروري به نظر مي‌رسد. در راستاي اجراي اين مهم، شوراي بازنگري قانون اساسي با توجه به خلا فقدان يك مرجع قانوني‌ سياست‌گذار كلان در قانون اساسي، در بازنگري سال 1368 اقدام به تاسيس نهاد «سياست‌هاي كلي نظام» در بندهاي 1 و 2 اصل 110 نمود. سياست‌هاي كلي نظام ثبات و انتظام امور را موجب شده و جهت‌گيري كلي نظام حقوقي جامعه را تبيين مي‌نمايند. در اين راستا، مهمترين و عالي ترين سطح اجراي سياست‌هاي كلّي نظام‌، سطح قانونگذاري است كه در اين خصوص هر چه ميزان انطباق‌ قوانين با سياست‌هاي كلّي تامين گردد، حسن اجراي سياست‌هاي كلّي و مسيله نظارت بر آن‌ نيز تضمين شده است كه بنابراين نقش مجلس شوراي اسلامي در تحقق اين مهم بسيار حايز اهميت خواهد بود و نگارنده در اين مقاله درصدد تبيين اين مهم مي‌باشد.

In a systematic society with clear legal frameworks, each of the powers, administrations and officials apply its powers and duties in line with the aims and ideals of the constitution as the highest document of the civil society. In order to attain this important issue, the revision council of the constitution regarding the lack of a legal general policy maker institution, established the institution of “General Policies” in the Article 110 of the constitution in the revision of the year 1368. The general policies cause the stability and discipline of the issues and explain the general orientation of law system of the society. In this line, the most important and highest level of complimenting the general policies is the legislation level. Therefore, it’s important to concord the laws with general policies so as to guarantee the proper execution of the general policies and to ensure the realization of its supervision. So the role of Iran’s Islamic Parliament is highly attended and the writer is to explain this importance.
