بررسي نقش و جايگاه مردم در نظريات مربوط به تشكيل حكومت در عصر حاضر از اهميت ويژه‌اي برخوردار است تا جايي كه پذيرش يا عدم پذيرش مردم ضابطه‌اي براي تقسيم حكومت‌ها به اقتدارگرا و مردمسالار تبديل شده است. از طرف ديگر از آن جا كه تشكيل حكومت اسلامي يكي از خواسته‌هاي شارع مقدس در جهت سعادت بشر و اقامه دين الهي مي‌باشد كه بر مبناي منابع شرعي تحقق آن در همه دوران‌ها واجب و ضروري به نظر مي‌رسد بررسي نقش و جايگاه مردم در تشكيل حكومت اسلامي ضروري است. براين مبنا در اين مقاله سعي شده تا نقش مردم در تشكيل حكومت اسلامي بر مبناي آرا فقها در مشروعيت بخشي به ولايت فقيه جامع‌الشرايط بر اساس نظريه انتصاب و انتخاب تبيين شود. سپس نقش و جايگاه مردم در تشكيل حكومت اسلامي در موازين ديني اعم از دلايل عقلي، نقلي و سيره ايمه معصومين مورد بررسي قرار گيرد و در پايان نيز ازمجموعه استنادات و استدلال‌هاي فوق تحليلي در اين باره ارايه شود. به نظر مي‌رسد مردم در تشكيل حكومت اسلامي نقشي اساسي و تعيين كننده دارند و تحقق حكومت اسلامي مبتني بر پذيرش يا عدم پذيرش آنان است. هرچند عدم پذيرش حكومت اسلامي به وسيله مردم موجبات مسيوليت در برابر خداوند متعال و عقوبت اخروي آنان را در پي خواهد داشت.

The consideration of people’s role in the theories concerning to the formation of the state is so important in the present day that peopleʹs acceptance or rejection is a criteria for the division of the states into authoritarian and democratic states. Moreover, since the establishment of the Islamic state is one of the holy legislator’s demands for human happiness and realization of the religion in which the fulfillment of that in all periods based on legal resources seems essential, The consideration of people’s role in the formation of Islamic state is mandatory. On this basis, this article strives to explain the role of people in the formation of Islamic state based on the opinions of jurists in Legitimizing to the qualified Velayate-faqih according to the theory of election and appointment. Then the role of people in the formation of Islamic state in religious rules whether rational, scriptural and the conduct of Imams will be examined and in the end, an analysis will be presented according to the mentioned documents and arguments. It seems that the people play an essential role in the formation of Islamic state and realization of the Islamic state is based on their acceptance or rejection. However, the rejection of people will make them responsible in front of God and the otherworldly punishments will follow them.
