The Authority of the Muslim Juristconsult and a Non-confessional Criticism

دكتر مهدي حايري يزدي از جمله انديشمنداني است كه در كتاب خود با عنوان «حكمت و حكومت» به نقد نظريه «ولايت فقيه» پرداخته است. برداشت نگارنده از نقد وي آن است كه بر خلاف تصور اوليه، نقد حايري يزدي، برون‌ديني است؛ چنانكه وي در ساخت و ابتكار نظريه وكالت و نظريه مالكيت شخصي مشاع، هرگز سعي نكرده از آموزه‌هاي ديني بهره گيرد. از آنجا كه نقد وي بر نظريه ولايت فقيه، پاره‌اي شبهات را پيش آورده است. در اين نوشتار، تلاش شده تا پاسخي در خور به نقد ايشان، ارايه گردد.

Dr. Mahdi H?eri Yazdi, among others, is a thinker who has made a critique of the thesis of “the Authority of Muslim Juristconsult” in his book entitled “Wisdom and Government”. The present writer understands his critique of the thesis in question as a non-confessional critique, though it might be conceived differently at first sight, since he has not made an attempt to make use of religious doctrines in constructing the theory of “representation” or Wik?lah and that of “joint private ownership”. Regarding the fact that his critique of the thesis of “the authority of jurist consult” has raised some doubts, the present article tries to provide an appropriate answer to the critique.
