The Role of Intellectual Property Rights in Finished Cost Reduction of Goods and Services

سياست اقتصادي كاهش قيمت تمام شده- به عنوان يك سياست اقتصادي كارا جهت افزايش قدرت رقابتي محصولات داخلي در مواجهه با رقباي خارجي- اخيراً مورد توجه وزارت صنعت، معدن و تجارت ايران قرار گرفته است. هرچند در نگاه نخست چنين بنظر مي آيد كه حمايت از اموال فكري نظير ابداعات و اختراعات، باعث افزايش قيمت تمام شده محصولات مي گردد اما با بررسي دقيق تر مي توان دريافت كه قوانين حمايت از حقوق مالكيت فكري مي تواند از بسياري جهات باعث كاهش قيمت تمام شده شود. از اين رو اعضاي كميته كاهش قيمت تمام شده كشور بخصوص وزارت صنعت، معدن و تجارت ايران بايد در بررسي عوامل موثر بر كاهش قيمت، به نقش مالكيت فكري و جايگاه آن در حقوق ايران توجه كافي نمايد. از آنجا كه تاكنون در ادبيات حقوقي ما، اين موضوع مورد بررسي علمي و كاربردي قرار نگرفته است، لذا اين مقاله مي كوشد تا ضمن رفع نسبي اين خلا تحقيقاتي، بدين پرسشها پاسخ دهد كه حمايت از حقوق مالكيت فكري چگونه باعث كاهش قيمت تمام شده مي شود؟ و اينكه آيا نظام مالكيت فكري ايران بگونه اي طراحي شده است كه به كاهش قيمت تمام شده كمك كند؟ براي ارايه پاسخ بدين پرسشها، مطالب اين نوشتار را در دو بخش بيان خواهيم كرد: در بخش نخست، ميزان تاثير مالكيت فكري در كاهش قيمت تمام شده را در مراحل زنجيره تامين همراه با مطالعه تطبيقي و در بخش دوم، جايگاه موضوع را در حقوق ايران نقد و بررسي كرده و در پايان، راهكارهاي كاربردي را به قانونگذار و دست اندركاران اجرايي كشور پيشنهاد خواهيم داد.

Recently, the finished cost reduction policy-as an efficient economic policy for competitiveness of domestic products beside foreign competitors-has been paying attention by Ministry of Commerce of Iran. At the fist look, the protection of intellectual property such as innovations and inventions increases the finished cost of products; but intellectual property protection can be effective in finished cost reduction in some area. Therefore, The Iranian Committee of Cost Reduction in particular Minister of Commerce must pay attention to the role of intellectual property Laws in cost reduction and its position in Iranian legal system. Since there is not any research in this area in Persian literature, this article tries to answer these questions: 1) How is the protection of intellectual property effective on finished cost reduction? 2) Does Iranian intellectual property system have effect on FCR? This article constitutes two sections: the first section considers the role of intellectual property in finished cost reduction with comparative study and the second section surveys the mentioned matter in Iranian Law. Finally, it suggests practical solutions to legislator and executives.
