The Relationship between Tort Law and the Law of Bankruptcy

از تداخل دو مقوله‎ي مسووليت مدني و ورشكستگي مسايل متعددي حادث مي‎شود كه پاسخ آنها را با مطالعه‎ي مجزا در قواعد هر يك از اين دو مقوله نمي‎توان يافت: مرز حقوق شخصي زيان‎ديده با حقوق مالي او كه متعلق حق غرما قرار مي‎گيرد، مسايل ناشي از ترتيب زماني مراحل ورشكستگي (از توقف تا صدور حكم و تصفيه) و مراحل مسووليت مدني (از انجام فعل زيان‎بار تا تحقق زيان)، دخالت اشخاص ثالث (همچون بيمه‎گر مسووليت و مسوولان متضامن) و مسايل مربوط به فرضي كه تقصير اشخاص ثالث در ايجاد ورشكستگي يا تشديد وخامت وضع مالي، موجب مسووليت آنها در قبال طلبكاران است، از جمله‎ي اين موضوعات است كه در اين مقاله مورد بررسي قرار مي‎گيرد.

Bankruptcy and tort; two apparently distinct branches of law, but, in fact, some technical and theoretical issues arise from their interaction. These include, among others, the boundaries between personal rights of the victim to damages, exclusively allocated to the bankrupt, and the financial damages , which belong to the creditors ; the problems resulting from the chronological order of the bankruptcy process (from the day on which the business man or company is bankrupted to the date of settlement of claims) and the chronological order of tort claims (from the occurrence of the cause of action to the compensation of the victim).
