نقش اينترپل در انجام معاضدات حقوقي و پليسي در راستاي استرداد مجرمين

Interpol’s role in mutual legal assistance and police cooperation regarding criminal extradition

هم زمان با توسعه و تحول جوامع، پديده جرم نيز دچار تحول گرديده است. بين‌المللي شدن جرم، حرفه اي شدن مجرمان، استفاده از فن آوري هاي نوين در ارتكاب جرايم و پديده جرايم سازمان يافته از مهم‌ترين مظاهر تمدن جديد بشري مي‌باشند. بنابراين اقتضا دارد پاسخ‌هاي جوامع در مقابل پديده مجرمانه نيز توسعه پيدا كرده و جرم را مهار و كنترل كند. در اين راستا و با تاكيد بر ازدياد همكاري‌هاي بين‌المللي، سازمان پليس جنايي بين‌المللي (اينترپل) تاسيس گرديده است. اين نهاد رسالت مهمي در همكاري‌هاي قضايي و پليسي بين‌المللي بر عهده دارد. از مهم‌ترين رسالت‌هاي اين نهاد، استرداد مجرمين است. كاركرد اينترپل در استرداد مجرمين در دو جهت عمده استوار است. نخست، كاركرد اصلي اين نهاد به عنوان متصدي امر استرداد مجرمين، كه به گواهي اساس‌نامه آن و رويه حاكم بر آن در بستر همكاري‌هاي قضايي و پليسي به صورت مستقيم در امر استرداد موثر واقع مي‌گردد. به لحاظ عدم بهره‌مندي اينترپل از خصوصيات حاكم بر نهادهاي عدالت كيفري رسمي بين‌المللي، همانند ديوان كيفري بين‌المللي شامل آمره بودن قواعد حاكم بر آن و داشتن ضمانت اجرايي در اين راستا، اين نهاد صرفاً داراي نقشي تكميلي است. حمايت تابعان حقوق بين‌الملل از اين نهاد و به خصوص هم رديف شدن آن با ديوان كيفري بين‌المللي از جمله مهم‌ترين پيشنهادات اجرايي در اين مسير است. دومين كاركرد اينترپل در استرداد مجرمين، تعامل اين نهاد با ساير نهادهاي بين‌المللي است كه به صورت غيرمستقيم در امر استرداد موثر است. در اين راستا هم سو شدن اينترپل با نهادهاي بين‌المللي همكار نقش مهمي در تسهيل امر استرداد ايفا مي‌كند.

Parallel with development and evolution of communities, crimes are also changing. In this regard, internationalizing crime, becoming professional criminals, using new technologies in committing offenses and organized crimes as a new phenomenon are the significant manifestations of modern human civilization. Therefore, societies’ responses against criminal phenomena have also developed so as to control crime. To reach this goal and also to underscore boosting of international cooperation in the field of fighting crime, the International Crime Police Organization, INTERPOL, is established. This Organization plats a pivotal role in police cooperation and mutual legal assistance. Extradition of criminals is the most important mission carried out by Interpol. Interpol’s function in extradition of criminals is on two bases. First, Interpol as the organization-in- charge of extradition of criminals acts in accordance with its constitution and in an atmosphere of mutual legal assistance and policing cooperation. Due to the fact that Interpol does not enjoy the ruling qualification on International Official Criminal Justice entities like International Penal Court which has the capability of ruling imperative laws and executive guaranty, it merely plays the supplementary role. Having the International law followers’ support of this entity and going in line with international penal Court are considered as its major executive suggestions. Second, Interpol’s role in extradition of criminals is cooperation with other institutions which indirectly assist in extradition cases.
