Domestic Violence Against Woman and the Role of Police in Terms of Responses

اين مقاله با استفاده از داده هايي كه از يك تحقيق كيفي در مورد خشونت عليه زنان به‌دست آمده است، بر آن است تا تجربه زيسته و تصور زنان را نسبت به انواع خشونت خانگي، علت‌هاي آن و نقش سيستم عدالت كيفري، قانون و پليس در برخورد با خشونت هاي خانگي تبيين و ترسيم كند. اين پژوهش براساس مصاحبه هاي عميق و نيمه ساختاريافته با 50 زن متاهل 63-18 ساله در تهران صورت گرفته است و فاقد قابليت تعميم آماري مي باشد. يافته هاي تحقيق حاكي از آن است كه اگرچه زنان خشونت هاي خانگي را امري به شدّت ناپسند و آسيب رسان مي دانند، اما بيشتر آن را مسيله اي شخصي و خصوصي تلقي مي كنند. از طرفي زنان خشونت عليه خود را امري اجتناب ناپذير نمي دانند، بلكه بر اين باورند كه با تغيير در قوانين و سيستم هاي فرهنگي كه مردسالاري را مورد حمايت قرار مي دهد، مي توان از خشونت هاي خانگي كه ‌‌به‌طور عمده در متن مناسبات قدرتي و نابرابري زنان و مردان تعريف مي شود، اجتناب كرد. زنان بر اين باورند كه حاكميت مردسالاري بر دستگاه هاي قانوني و اجرايي مانع از برخورد با خشونت هاي خانگي مي گردد. نتايج تحقيق در اين راستا قابل تفسير است كه خشونت هاي خانگي به سهولت قابل پيگرد قانوني نمي باشد، مگر آن‌كه قربانيان خشونت عزم خود را در جهت پيگيري قانوني جزم كنند و از طرفي، قانون گذار نيز خشونت‌هاي خانگي را جرم تلقي كند و براي خاطيان و مجرمان تنبيه مناسبي را در نظر گيرد.

Domestic violence against women and the role of police in terms of responses to violent abusers Soheila Sadeghi Atena Kamel Ghalibaf Abstract: This article uses data from qualitative research which carried out to understand the lived experience of women toward domestic violence as well as the causes of violence. It has been also the intension of the article to look at the viewpoint of women toward the role of criminal justice system, law and police in term of response to violent abusers. Data presented in this article is collected through in depth semi structured interview with 50 married women in Tehran aged 18 to 63. Since the size of sample is small it is not possible to make any statistical analysis and generalization. Finding suggests that domestic violence occurs in unequal context of power relations. Although women view domestic violence as terrible and quiet harmful but considered that as private and personal issue. Women are not interested to press charges against their violent husbands because they think it is useless since men are in control of law enforcement. However women have come to believe that domestic violence is avoidable if some changes are made in laws and cultural system which in their view are dominated by male interest. Nevertheless the domestic violence is not pursuable unless the women decide to take an action and press charges against perpetrators. Besides, the justice system should play vitally important role in wider efforts to seek an effective response to violent abuser to reduce harm and protect women against domestic violence.
