A Critical Review of Foundations and Methodology of Rawls Theory of Justice

كتاب نظريه عدالت جان رالز از جمله آثار تاثير‌گذار در حوزه عدالت در قرن بيستم هست به طوري كه در زمان حاضر، غالب محققان عدالت پژوه در اثر خود يا به رالز ارجاع مي‌دهند يا براي رد آن و ارايه نظريه خود، نظريه رالز را مورد نقد و بررسي قرار مي‌دهند. با توجه به همين اهميت، نقد و بررسي اين نظريه نقش مهمي در پيشبرد مطالعات حوزه عدالت در كشور مي‌تواند داشته‌ باشد. به ‌نظر نويسندگان در بررسي هر نظريه عدالت به سه موضوع و مولفه بايد توجه كرد: اول، نظريه مذكور مبناي عدالت را چه مي‌داند؟ پاسخ به اين سوال روش‌شناسي نظريه‌پرداز عدالت در تبيين مفهوم مورد نظر خود از عدالت را نيز مشخص مي‌نمايد. دوم نظريه، عدالت را در چه حوزه و قلمرويي طرح مي‌نمايد؟ و در نهايت نظريه چه مفهومي از عدالت را ارايه مي‌نمايد؟ بازسازي نظريه رالز و نقدهاي وارد به پاسخ‌هاي رالز به اين سه پرسش نشان مي‌دهد عليرغم تلاش و ادعاي رالز براي ارايه نظريه بديل و جايگزين عدالت فايده‌گراي كلاسيك، نظريه وي دستاوردي متمايز از آن نمي‌تواند داشته باشد.

Rawlsʹ "A Theory of Justice" has been one of most influential works in the subject in 20th century, to the extent that whoever writes on the subject nowadays, should address his views in a way, whether to refer to his theory or put forth critiques to present his own theory. Regarding this prominence, critical study of this theory would have a vital role in advancement of justice studies in our country. According to our views, in studying any theory of justice three issues or elements should be put under scrutiny: First, what is the basis or the criterion of justice in that theory? The answer to this question will determine the methodology of the scholar in explaining his own concept of justice as well. Second, what is the domain in which justice is defined in that theory? Finally, what definition of justice is suggested by the theory? Reconstructing Rawlsʹ theory in addition to the critiques of his responses to the above questions indicates that, in spite of Rawlsʹ attempt and to suggest an alternative to the classical utilitarian theory of justice, his theory could have no distinct consequences.
