افزايش احترام به حقوق‌بشر در پرتو مكانيسم «بررسي ادواري جهاني

Promotion of Human Rights in the Light of Universal Periodic Review

با تاسيس شوراي حقوق‌بشر، مكانيسم‌هاي جديدي به منظور افزايش احترام به حقوق‌بشر در شورا مورد توجه قرارگرفت. يكي از اين مكانيسم‌ها، سازوكار «بررسي ادواري جهاني» موسوم به يو پي آر است كه وضعيت حقوق‌بشر كشورها را مورد رسيدگي قرار مي‌دهد. سازوكار مزبور يك چهارچوب نظارتي و ارتقايي مبتني بر تعامل، گفت‌وگو و همكاري و مشاركت كشورها بوده و هدف از آن تقويت احترام به حقوق‌بشر در سراسر دنيا است. ارتقايي بودن ماهيت سازوكار مزبور، فراگيري بررسي‌ها و برابري همه كشورها در اين ارزيابي‌هاي حقوق‌بشري، جلب مشاركت و همكاري دولت‌ها و نهادهاي غيردولتي و تعامل برابر با ابعاد مختلف حقوق‌بشر، از ويژگي‌هاي مثبت سازوكار بررسي ادواري جهاني به شمار مي‌رود. با اين وجود، سازوكار مزبور از ضعف‌هاي عمده‌اي نيز رنج مي‌برد. اعمال ملاحظات سياسي در رسيدگي‌هاي حقوق‌بشري، عدم تفكيك بين توصيه‌هاي اريه شده در فرايند بررسي ادواري جهاني با توصيه‌هاي نهادهاي معاهده‌اي و رويه‌هاي ويژه، عدم پذيرش بسياري از توصيه‌هاي محتوايي از سوي كشورها، عدم وجود يك سازوكار واحد براي پيگيري و اجراي توصيه‌ها و نقش كم‌رنگ نهادهاي ملي حقوق‌بشر در اجراي توصيه‌هاي حقوق‌بشري، از چالش‌هايي به شمار مي‌روند كه تحقق اهداف شوراي حقوق‌بشر را تحت تاثير قرار مي‌دهد.

Following the establishment of the Human Rights Council in 2006 to replace former Commission of Human Rights, a few new mechanisms were designed in the Council to support its goals of promotion and protection of human rights in the world. One of these mechanisms was Universal Periodic Review (UPR). The UPR is an incentive mechanism based on interaction, mutual dialogue and partnership of all states which reminds states of their responsibility to fully respect and implement all human rights and fundamental freedoms. As one of the main features of the Council, the UPR is designed to ensure equal treatment for every country without any political considerations and biased attitude when their human rights situations are assessed. However, this unique inter-governmental human rights monitoring system faces major challenges. Group alliance and factionalism remains a veritable force in the conduct of "Universal Periodic Review" and the Council as well. Numerous recommendations are formulated in a vague and general manner, making any follow-up process extremely difficult. Moreover, National Human Rights Institutions are failed to have a successful intervention in preparing the national reports and conducting recommendations made during the review.
