Impact of Hermeneutics on Jurisprudence and its Fundamentals

با ورود موضوعات و بحث‌هاي فلسفي غرب به حوزه‌هاي علمي جهان اسلام، مسايل و مباحث جديد فراروي دانشمندان اين حوزه قرار گرفته است. يكي از اين علوم كه بحث‌هاي زيادي را در حوزه فهم، معرفت و تفسير در علوم اسلامي برانگيخته است، دانش هرمنوتيك مي‌باشد. مقاله حاضر به برخي از اين مباحث و مسايل فقط در حوزه ارتباط اين دانش با دانش اصول فقه مي‌پردازد. پرسش‌‌هايي از اين دست كه آيا اساساً ارتباطي ميان اين دو شاخه از علم وجود دارد و مي‌تواند يكي بر ديگري تاثير نهاده يا متاثر از آن باشد؟ آيا دانش هرمنوتيك بر فرض تاثيرگذاري، از مسايل فلسفه علم اصول است يا خود يك مسيله اصولي نو‌پديد است؟ چگونگي تعامل يا تاثير‌گذاري هريك از رويكرد‌هاي هرمنوتيكي بر علم اصول چگونه است؟ اين پرسش‌ها از جمله موضوعاتي است كه نوشتار حاضر به دنبال پاسخ‌گويي به آن است. در اين مقاله پس از توضيح اجمالي مفردات موضوع و بيان تمايزات اساسي ميان دو رويكرد مهم در هرمنوتيك، نخست ديدگاهي كه مدعي عدم ارتباط ميان دانش هرمنوتيك و علم اصول مي‌باشد، به نقد كشيده شده است. در مرحله دوم، جايگاه بحث هرمنوتيك نسبت به علم اصول و اينكه آيا از مبادي علم اصول بوده يا از مسايل آن، تبيين شده است و پس از آن چگونگي تاثير هركدام از دو رويكرد اساسي در هرمنوتيك، يعني هرمنوتيك كلاسيك و هرمنوتيك فلسفي بر مباحث اصولي به طور مستقل مورد بحث واقع شده است.

With the advent of Western Philosophy discussions in Islamic world, Islamic scholars have faced new topics in this regard. Hermeneutics is one of these sciences, which has raised lots of debates in the areas of understanding, knowledge and commentary in Islamic sciences. This article mentions only some of the debates of this area which are related to Jurisprudence. There exist questions such as whether there is a connection between these two branches of the science and or one of these fields can impact on the other or be impacted by. If assumed that the Hermeneutics is effective [on other sciences], then is it part of the Jurisprudence or is it an emerging juridical issue by itself? Among the issues being discussed in this article is how do the Hermeneutic approaches interact with the Jurisprudence or impact on. In this article after a brief explanation of the case and expressing the fundamental distinctions of the two approaches in Hermeneutics, first, a view that maintains no relationship between hermeneutics and Jurisprudence has been criticized and in the second stage, the status of the Hermeneutics in comparison to Jurisprudence and also this question whether the Hermeneutics is part of the Jurisprudence have been explained. Finally we try to consider how the two fundamental Hermeneutic approaches (i.e. Classic Hermeneutics and Philosophic Hermeneutics) independently impact on Jurisprudence.
