Protection of Handicrafts in Iran in light of Intellectual Property

صنايع دستي و هنرهاي سنتي در هر منطقه، در ابعاد مختلف اجتماعي، فرهنگي و غيره ايفا مي كند. در واقع، هويت مردم بستگي به اين هنر- صنعت دارد. امروزه استفاده از ابزارآلات فرهنگي به عنوان منبع خلاقيت نقش مهمي در توسعه جوامع سنتي داشته و پيشبرد توسعه پايدار را در پي دارد. بي شك نمي توان از نقش اقتصادي آن به عنوان در آمد اصلي و جذب توريسم غافل ماند. متاسفانه در سال هاي اخير به دليل ناكارآمدي و بي توجهي دستگاه هاي متولي، كشورهاي ديگر آثاري را به تقليد از هنرهاي اصيل ايراني توليد و با قيمت پايين و تركيبات نامرغوب وارد بازارهاي بين المللي و ايران مي كنند، بي آنكه حقوق توليدكنندگان ايراني را در نظر بگيرند. همين عامل باعث لطمات اقتصادي و فرهنگي به كشور شده است. از اينرو، حمايت حقوقي از هنرهاي دستي در قالب حقوق مالكيت فكري نتايج بسيار سودمندي را براي كشور در بر خواهد داشت. نقش نظام هاي حاكم و انتخاب بهترين نظام و راه حل بر اين حمايت در پيشبرد اهداف موثر است. در اين مقاله سعي شده است بهترين نظام براي حمايت از صنايع دستي ايران ارايه گردد.

Handicrafts and traditional arts play an important role in society. Peoples’ identification essentially depend on the art industry. Today, the use of cultural tools as a source of creativity has an important role in the development of traditional societies and result in the promotion of sustainable development. Undoubtedly, we must consider its economic role as the main source revenue and attraction for tourism. Unfortunately in recent years, due to inefficiency and lack of attention by the trustees, foreign countries have imitated and produced works of Iranian original art and imported them with lower prices and inferior ingredients into international and Iranian markets without considering the rights of the Iranian producers. This can cause damage to the countryʹs economy and culture. Hence the legal protection of traditional arts in the form of intellectual property rights has many positive results for Iran. The role of the government, choosing the best system and solution to support this protection is effective in promoting these goals. This paper will survey and present the best system for the protection of Iran’s handicrafts.
