جايگاه اصل حاكميت قانون در ارتباط با تضمين حقوق شهروندي توسط پليس

The Position of the Rule of Law Principle vis-à-vis Police Respecting Citizenship Rights

در اين مقاله تلاش شده است اصل حاكميت قانون به عنوان اصل كليدي و زير بناي نظام حقوق شهروندي مورد بررسي قرار گيرد. در آغاز دركي كلي از اصل حاكميت قانون ارايه مي‌شود تا زمينه‌ بحث از پيامدهاي حاكميت قانون در ايجاد نظام ملي حقوق شهروندي و بويژه در ساماندهي رابطه مقامات اجرايي (از جمله نيروهاي پليس) و شهروندان فراهم گردد. سپس تلاش مي‌شود تا مهمترين آثار اصل حاكميت قانون در عرصه‌هاي مختلف نظام حقوقي تبيين، و به طور حصري چهار نتيجه بنيادين ناشي از حاكميت قانون استخراج شود كه عبارت است از : اصل برابري شهروندان در برابر حاكميت قانون ،اصل حاكميت قانون بر جرايم ،اصل حاكميت قانون بر كشف جرايم و فرايند تعقيب و تحقيق در مورد آنهاو اصل رعايت فرض قانوني برايت در ارتباط با تمام شهروندان . اين اصول را مي توان به طور كلي به مثابه اصول راهبردي حقوق شهروندي در ارتباط با عملكرد نيروهاي پليس نيز مورد توجه قرار داد. در اين مقاله سعي شده است در هر مورد، پژوهشي در محتواي اصل، مباني، سابقه تاريخي و آثار و نتايج آن صورت گيرد و از زاويه‌ كاربردي، الزاماتي كه در ارتباط با اين اصول براي پليس ايجاد مي‌گردد به طور در هم تنيده‌اي با همه‌ چارچوبها مورد واكاوي قرار گيرد.

n attempt has been made in this study to investigate the principle of rule of law as the key principle underlying the system of citizenship rights. First, a general understanding of this principle will be presented to pave the way for discussing consequences of rule of law in establishing the national system of citizenship rights and, especially, in organizing the relationship among the law enforcement agencies (including the police forces) and citizens. Then, attempts are made so that the most important effects of the rule of law principle will be explicated in different legal systems, and four separate fundamental results will be extracted from the rule of law principle, including: principle of equality of citizens before rule of law, principle of rule of law on crimes, principle of rule of law on crimes detection and the process of prosecuting and investigating them, and principle of observance of null poena sine lege vis-à-vis all citizens. These can also be generally regarded as strategic principles of citizenship rights in relation to the performance of police forces. An attempt has been made in this study, on a case-by-case basis, to explore contents of the principle, its fundamentals, historical background, effects and results and, from an applied standing, investigate the obligations binding upon the police in connection with these principles in a detail with all frameworks.
