اين پژوهش به بررسي نقش راهبردي زمان و مكان در اجتهاد در بخش نظامي مي‌پردازد. نظريه‌هاي مختلفي در باره تاثير زمان و مكان بر احكام شرعي وجود دارد. جهت گيري اين پژوهش بررسي مفهوم زمان و مكان و نقش راهبردي اين دو در اجتهاد و آراي فقيهان در بخش نظامي است كه موجب پويايي فقه در همه زمان‌ها و مكان‌ها مي‌شود و چنين رويكردي اهميت پرداختن به اين موضوع را نشان مي‌دهد. معناي نقش داشتن زمان و مكان در اجتهاد آن نيست كه دو عنصر زمان و مكان به عنوان يكي از منابع اجتهاد تلقي شوند، زيرا در فقه سنتي و اجتهاد جواهري كه امام خميني (ره) قايل به آن هستند و از مشايخ سلف به ارث رسيده، عناصر زمان و مكان به عنوان منبع اجتهاد شناخته نشده است. بايد توجه داشت كه كتاب و سنت به گونه مستقيم در ناحيه احكام شرعي در مقام اجتهاد نقش دارند، اما زمان و مكان مستقيماً در مقام اجتهاد در ناحيه مشخص كردن ملاك‌ها احكام و موضوعات و ويژگي‌هاي آنها داراي نقش است و موضوعي در زمان خاصي مي‌تواند داراي حكمي باشد ولي در زمان ديگر داراي حكمي بر خلاف حكم اول شود، به دليل تغيير ملاك يا ويژگي‌هاي آن. بنابراين، زمان و مكان بي واسطه در ناحيه ملاك و موضوع و مشخص كردن آنها نقش دارند نه در ناحيه احكام.

The current paper examines the strategic role of time and place in Ejtehad in military section. There are various opinions about the impact of time and place on religious commands. The orientation making of this research is exploring the concept of time and place and strategic role of both of them in Ejtehad and opinions of Jurisprudents in military section which lead the dynamism of religious rules and principles in all times and places and such approach indicates the significance of studying this issue. The concept of having roles of time and place in Ejtehad does not mean that two elements of time and place are considered as one of the sources of Ejtehad. Because in traditional religious rules and principles and Javaheri Ejtehad which late Imam Khomeini (R.A) takes into consideration and has been inherited from great predecessors, the elements of time and place have not been recognized as the source of Ejtehad. It should be taken into consideration that Holy Quran and Sunnah have direct roles in Ejtehad position in religious comammands section. But time and place have roles in determination of criteria, commands and issues as well as their characteristics. That is why an issue could have a command in a special time but in another time it could have opposite command which is contrast of first command because of changing the criterion or its characteristics. So, time and place have roles directly in issue and criterion and determination them and not in commands field.
