بررسي وقف پول با رويكردي بر آراي امام خميني(س)

A Study of Endowment of Money on the Basis of Imam Khomeini’s Viewpoints

وقف، سنّت حسنه‌اي است كه نه تنها در اسلام، بلكه در ساير اديان و مذاهب و حتي در ميان اقوام و ملل ديگر مورد توجه و تاييد قرار گرفته است. ترويج نهاد وقف در جامعه تاثير بسزايي در توسعه اقتصاد كشور دارد و با پر كردن خلاها و رفع نيازهاي فرهنگي، اجتماعي و اقتصادي مردم كمك شاياني براي دولت به شمار مي‌آيد. آنچه در گذشته مورد وقف قرار مي‌گرفت زمين، خانه، باغ و بعضاً اموالِ منقولِ داراي ارزش ذاتي بود، اما امروزه با پيشرفت‌هاي اقتصادي، نيازهاي جديدي به وجود آمده كه رفع آنها با روش‌هاي سنتي گذشته سخت يا ناممكن است. در اين ميان تغيير ماهيت پول و ظهور پول‌هاي رايج امروزي كه صرفاً داراي ارزش اعتباري هستند بسيار حايز اهميت است و نقش ويژه‌اي را در اقتصاد كنوني به عهده دارد. به همين دليل وقف پول مي‌تواند مصداق جديدي از وقف باشد و ظرفيت‌هاي مالي جديدي را در حوزه وقف ارايه دهد و نقش مثبت و سازنده اين نهاد را همچنان در جامعه حفظ نمايد. با اين همه در مورد وقف پول دو نظريه مطرح است. برخي از فقها آن را صحيح نمي‌دانند و براي اثبات ادعاي خود ادله‌اي ارايه كرده‌اند. در مقابل، گروهي ديگر ضمن نقد ادله مخالفين، وقف اين ارزش‌هاي اعتباري را صحيح و منطبق با موازين شرعي دانسته و به اثبات آن پرداخته‌اند. در اين مقاله تلاش كرده‌ايم ضمن تبيين ديدگاه‌هاي امام خميني در اين زمينه نظريات و دلايل هر يك را جداگانه مورد بررسي قرار دهيم و در پايان ضمن تاكيد بر اهميت مديريت مالي وقف، مدلي پيشنهادي براي تامين اين هدف ارايه نماييم.

Endowment is a good tradition, which is not only confirmed by Islam but also by other religions and religious denominations and even communities and nations. The promotion of endowment has a crucial effect on the economy of the country and through fulfilling cultural, social and economic needs endowment renders outstanding assistance to the people and government. In the past, people normally endowed land, house, garden, and some moveable properties with essential values, but today, with the economic progress, new needs have emerged whose fulfillment is difficult or impossible through traditional methods. On the other hand, the transformation in the nature of money and emergence of prevailing monies that have credit value is very important and play a very crucial role in the current economies. Hence, endowment of money can be a new referent of endowment that offers new financial capacities in the field of endowment and also preserves the constructive role of this institution in the society. There are two viewpoints about the endowment of money: one group of jurisprudents maintain that endowment of money is not correct while others argue that endowment of credit values is congruent with religious values. The present article is an attempt to discuss the said two viewpoints as well as those of Imam Khomeini. Also a model has been offered in this regard.
