Nature, Entity and Analytical Thought’s Characteristics of Governmental Jurisprudence in the Heaven of Imam Khomeini’s Political- Jurisprudential Thought

قه شيعه از رهگذر اجتهاد پيوسته در حال تحول و نوآوري است و توانسته است مسايل مستحدثه سياسي را با توجه به نيازهاي جامعه در بافت­ هاي فرهنگي گوناگون پاسخ دهد. از سويي با پيروزي انقلاب اسلامي وحاكميت فقه و فقيهان بر حوزه­ ي مديريت جامعه بسياري از پرسش­ هاي مستحدثه جامعه اسلامي به دستگاه فقه عرضه شده و توقع صدور حكم دارند كه رويكردهاي فقهي با توجه به مباني فكري واجتهادي خود در صدد پاسخ به آن بر آمدند. دراين بين رويكرد فقه حكومتي، معتقد به توانمندي فقه اسلامي در اداره­ ي جامعه است و تنها راه تحقق شريعت در حوزه­ي فردي و اجتماعي را تاسيس حكومت اسلامي مي­ داند. اين رويكرد در صدد است صورت­ بندي جديدي از مناسبات فرد و دولت ارايه نمايد. مقاله پيش­رو آهنگ آن داردكه ويژگي­ ها، ابعاد و سويه­ هاي اجتهادي (روش­ شناسي) فقه حكومتي را در در جمهوري اسلامي و با تاكيد بر انديشه فقهي-سياسي امام خميني(ره) بررسي و تحليل نمايد و بر اين فرض استوار است كه فهم اجتهادي فقيهان معاصر به ويژه امام خميني(ره) از شريعت و منابع فقهي، موجب گذار از فقه فردي به فقه حكومتي گرديده است از اين رو علاوه بر اشتراكات فراوان با رويكردهاي غيرحكومتي به فقه ويژگي­ هاي اجتهادي ديگري در آثار و اجتهادات ايشان وجود دارد كه موجب تمايز با ساير رويكردهاي فقهي مي­ گردد.

The Shia jurisprudence through the way of analytical thought is continuously being changed and developed, and could respond to the political modern issues, considering the society requirements in different cultural contexts. On one hand, by the victory of the Islamic revolution, and the governance of jurists and jurisprudence on the domain of management of the society, most of the modern queries of the Islamic society was presented with the jurisprudential system, from which they expect the issuance of writ, and then the jurisprudential approaches, considering their intellectual and analytical thought bases, sought to obtain a response for it. Therefore, this article is intended to analyze the analytical thought’s features, dimensions and lineages (methodology) of governmental jurisprudence in the Islamic republic with an emphasis on the jurisprudential-political thoughts of Imam Khomeini. Hence, it is still steady on the basis of this hypothesis that the analytical thought understanding of the contemporary jurists especially Imam Khomeini from the religion and jurisprudential resources, has caused the transmission of individual jurisprudence to the governmental jurisprudence. In this way, in addition to several communalities with non-governmental approaches toward the jurisprudence, there are other analytical thought features in his works and Jihads which has resulted in a distinction with other jurisprudential approaches.
