يكي از دارايي‌هاي انسان كه ممكن است مورد تعرض ديگران واقع شود، جسم و جان اوست كه البته با ارزش‌ترين دارايي انسان محسوب مي‌شود و در حقوق اسلام نيز حفظ و احترام به آن شديداً مورد توجه قرار گرفته است، تعرض به تماميت جسماني اشخاص از دو جنبه حقوقي و كيفري باعث ايجاد مسووليت مي‌شود. فراهم كردن شرايط ورود ميكروب به بدن افراد از اين قبيل است؛ بعضي از اين ميكروب‌ها كشنده هستند و پس از ورود به بدن عوارضي را ايجاد نموده و پس از گذشت مدت زماني فرد را به كام مرگ مي‌كشاند. حال اگر فردي مانند پزشك، بدون سو نيت و اطلاع، باعث آلوده‌شدن ديگري به اين نوع ميكروب‌ها گردد، در مقابل فرد آلوده شده تا چه ميزان مسووليت دارد؟ از آنجايي كه مباني فقهي، فرد مبتلا به بيماري كشنده را در حكم متوفي قرار مي‌دهد، اين موضوع مي‌تواند مستمسك خوبي در جهت صدور حكم به ديه كامل در حق زيان ديده باشد.
