جايگاه پليس ويژه كودكان و نوجوانان در فرايند دادرسي كيفري

ضابطين دادگستري، بازوهاي اجرايي دادسراها و دادگاه ها در انجام وظايفشان هستند و قانون تكاليف زيادي بر عهده آنان نهاده كه از نخستين لحظه هاي پس از وقوع جرم تا واپسين دقايق اجراي مجازات را در بر مي گيرد. اين وظايف و اختيارات نمايانگر آن است كه افرادي با ويژگي هاي خاص و منحصربفرد بايد در اين جايگاه قرار گيرند. در بزهكاري كودكان و نوجوانان اهميت اين موضوع دو چندان مي شود؛ زيرا در فرايند دادرسي آنها، بيشترين احتمال آسيب و نقض معيارها وجود دارد. بنابراين وجود و حضور پليسي كه در زمينه برخورد با كودكان و نوجوانان آموزش ديده و متخصص باشد راهگشاست. به نظر مي رسد به دلايل مهمي مانند حساسيت قشر كودك و نوجوان و آسيب پذيري اجتماعي و رواني آنان، مصون نگه داشتن آنها از عواقب زيانبار مداخله نظام كيفري و نيز پيشگيري از وقوع جرايم آتي تشكيل پليس ويژه كودك و نوجوان در فرايند دادرسي امري ضروري است. در همين راستا، اسناد بين المللي لازم الاجرا بر ضرورت وجود آن تاكيد نموده و مقررات خاصي را نيز در اين زمينه تدوين نموده اند و به تبعيت از آن، بيشتر كشورهاي پيشرفته نيز اقدام به تاسيس اين نهاد نموده اند. هر چند در سياست جنايي تقنيني و قضايي ايران، اين امر مورد توجه قرار نگرفته بود؛ اما خوشبختانه قانون برنامه پنجم توسعه مصوب 15/10/1389 و نيز تدوين لايحه قانون آيين دادرسي كيفري و لايحه رسيدگي به جرايم اطفال كه براي تصويب به مجلس شوراي اسلامي تقديم شده، گامي مثبت در اين جهت برداشته است. اميد است هر چه سريعتر قانونگذار اين مقررات را تصويب نمايد تا پليس ويژه كودك و نوجوان با لحاظ استانداردهاي لازم و بهره گيري از تجارب ساير كشورها تاسيس شود.

Enforcement officials of court are executive arms of the public prosecutor and the courts in performing of tasks and the law placed many duties upon them so that encompasses from the first moments after the crime until the last minute penalty. The duties and powers show that people with specific and unique features should be placed in this position In children and adolescents delinquency, this is a very important issue; because it is most likely to damage the hearing process and criteria are violated. So the presence of police that is trained and qualified in dealing with children and young people is helpful. It seems that due to important reasons such as Sensitivity of children and adolescents and their social and psychological vulnerability, keeps them safe from the harmful consequences of criminal involvement and also for prevent from their future crimes; formation a special police for children and adolescents in the justice process is essential. In this regard, binding international documents emphasis on the its presence necessity and have developed special regulations in this field and followed by it, most developed countries have established the institution. However in the legislative and criminal justice policy on Iran, this was not considered; but fortunately, the fifth development plan that approved in 1389/15/10 and also criminal law bill drafted and bill to address the crimes of children who presented for approval to parliament, has taken a positive step in this direction. It is hoped that as soon as the legislature shall enact laws so with the required standards and by using the experiences of other countries, adolescents and children police be established
