«تكاليف شهروندي» در قانون اساسي جمهوري اسلامي ايران

شهروند، مفهومي حقوقي است كه در مباحث حقوق عمومي و حقوق بشر مطرح مي‌شود. وجه مشترك تعاريف حقوقي درباره شهروند، رابطه‌اي است كه بين فرد و حكومت وجود دارد. اين رابطه، رابطه‌اي دوسويه است كه دربرگيرنده طيف وسيعي از حقوق و تكاليف است؛ يعني شهروند در مقابل حقوقي كه در برابر دولت دارد، هم‌زمان تكاليف و مسيوليت‌هايي نيز بر عهده دارد كه موظف به انجام آن‌هاست. در يك حكومت مردم‌سالار، قانون اساسي، به عنوان يك ميثاق ملي و سند حقوقي، زمامداري را سامان مي‌بخشد و حكومت و مردم در روابط متقابل خود مكلف به رعايت آن هستند. در قانون اساسي جمهوري اسلامي ايران نيز فصلي تحت عنوان حقوق ملت وجود دارد كه به تشريح حقوق شهروندان و متقابلاً وظايف دولت مي‌پردازد. اما در اصول ديگري از قانون اساسي، تعدادي از وظايفي كه شهروندان در برابر حكومت بر عهده دارند، مورد اشاره قرار گرفته كه از آن به تكاليف شهروندي ياد مي‌كنيم. در اين مقاله در پي تشريح تكاليفي كه در قانون اساسي جمهوري اسلامي ايران، بر عهده شهروندان اين دولت است هستيم.

The Citizen is a legal concept addressed in public law and human rights issues. Common aspect of legal definitions about the citizen is the relationship between the individual and the state. This is a two-way relationship that involves a wide range of rights and duties, namely the citizen while possessing the rights, is obliged to perform simultaneously the duties and responsibilities. In a democratic state, the constitution organizes the government and public administration as a national covenant and a legal document in which the state and the people are obliged to follow in their mutual relations. There is also a chapter in the Constitution of the Islamic Republic of Iran entitled the rights of people which explains the rights of citizens and mutually the duties of the state. Nevertheless, a number of citizen’s duties have been mentioned in other principles of the constitution known as the citizenship duties. In this article, we are to explain the duties of the citizens in the constitution of Islamic republic of Iran.
