Legal aspects of the voting right in the legal system of the Islamic Republic of Iran

شركت در انتخابات و راي دادن در نظام حقوقي ايران داراي وضعيتي متفاوت با نظام‌هاي حقوقي ديگر است. در نظام حقوقي ايران كه بر مبناي فقه اماميه ترسيم شده است، اعمال حق راي با مسيوليت افراد در تعيين سرنوشت خويش، مسيوليت افراد در برابر حقوق ساير اشخاص در اجتماع و نيز اقتدار و استواري حكومت اسلامي پيوند خورده است و با توجه به اصل تلازم حق و تكليف نمي‌توان اعمال حق راي را امري كاملاً شخصي و حق فردي ارزيابي كرد. هدف از انجام اين پژوهش بررسي ابعاد حقوقي اعمال حق راي و نسبت سنجي آن با مسيوليت افراد در قبال ساير اعضاي جامعه و نيز حكومت اسلامي از طريق پژوهش به روش كتابخانه‌اي است كه منجر به كشف ماهيت حقوقي حق راي بشود.

Participating in elections and voting in the Iranian legal system has a status different from other legal systems. In Iranʹs legal system which is based on the Shiite jurisprudence, the right to vote has been blended with the responsibility of the people in self-determination, the responsibility of the people versus the rights of others in the community and also sovereignty and stability of the Islamic state and according to the correlation principle of right and duty, the voting right can’t be assessed an absolutely individual matter and a personal right. The purpose of this article is the examination of the legal aspects of the voting right and its responsibility towards the rest of the society and also Islamic state through researching by the library method, so as to result in understanding the legal nature of voting right.
