تحريم‌هاي بين‌المللي ناقض حقوق بشر:از چالش مشروعيت حقوقي تا مسيوليت بين‌المللي

International Sanctions Violate Human Rights: From Challenge of Legal Legitimacy to International Responsibility

شوراي امنيت بعد از جنگ سرد با استناد به فصل هفتم منشور به نحو گسترده‌اي از ابزار تحريم استفاده نموده است. مطالعه پيامدهاي حاصل از اعمال تحريم‌ها در كشورهاي هدف نشان مي‌دهد، بيشترين رنج و آسيب اين محدوديت‌ها بر مردم عادي وارد شده و موازين حقوق بشر در اثر تحريم‌ها به نحو گسترده‌اي مورد نقض قرار گرفته است. از آنجا كه مسيوليت حفظ صلح و امنيت بين‌المللي در پرتو رعايت اهداف و اصول سازمان ملل و مقررات منشور، به شوراي امنيت واگذار شده، ‌وضع چنين تحريم‌هايي به لحاظ نقض مواد 1، 24 و 55 منشور و ساير معاهدات حقوق بشر، تخطي از حدود صلاحيت و اختيارات قانوني اين شورا تلقي شده و فاقد اعتبار است و به لحاظ تخلف شوراي امنيت از تعهدات بين‌المللي خود در زمينه حقوق بشر، موجبات مسيوليت بين‌المللي اين شورا و به تبع آن، سازمان ملل تحقق پيدا مي‌كند.

Following the end of the Cold War, the United Nations Security Council has in many cases relied on Chapter VII of the Charter of the United Nations in order to impose sanctions on various countries. Review of the outcome of these sanctions in different countries will reveal that ordinary people have suffered the most while various norms of international human rights have been violated. Since the Security Council is the main organ responsible for protecting international peace and security within the framework of the principles stipulated in the UN Charter, imposition of such sanctions has led to violation of articles 1, 24, and 55 of the Charter and other human rights treaties. As a result, the sanctions are not within the jurisdiction of the Security Council and should be considered invalid. Also, since the Security Council has violated its international mandate with regard to human rights, the Council, and subsequently the United Nations, are liable to international responsibility.
