Reflections on Modern Principles of Administrative Law in State Services Management law (Analysis of Article 90 of State Services Management Law

اصول مدرن حقوق اداري، هنجارهاي ارزشمندي هستند كه در حقوق اداري اكثر كشورهاي پيشرفته و توسعه‌يافته شناسايي شده و در جهت توسعه حقوق اداري و به منظور نيل به يك اداره كارآمد و تضمين‌كننده حقوق و آزادي‌هاي بنيادين شهروندان به كار بسته مي‌شوند. در اين مقاله اصول فوق از منظر قانون مديريت خدمات كشوري بررسي مي‌شوند. اين قانون در استفاده از بسياري از اصول گفته‌شده موفقيت‌هاي قابل تحسيني داشته و نويسندگان آن با الهام از اصول يادشده، اصولي مانند حاكميت قانون، برابري، بي‌طرفي، پاسخگويي، شفافيت، دسترسي به اطلاعات و اسناد اداري، رفتار مودبانه، تكليف به راهنمايي، سرعت در پاسخگويي و ... را به خوبي در قانون فوق گنجانده‌اند. از آنجا كه مهم‌ترين ماده در بيان اين اصول، ماده 90 قانون مي‌باشد، در اين نوشتار اين ماده، در كنار تحليل ساير مواد قانون مديريت خدمات كشوري و ديگر قوانين و مقررات و با يك نگاه تطبيقي بررسي شده است. اصول حقوقي به صراحت در ماده 90 گنجانده شده و اصول اخلاقي به‌طور غيرمستقيم و با امعان نظر به مفاهيم بسيار نزديك، مشابه و معادل آنها در حقوق خارجي قابل شناسايي هستند، در اين ماده پيوند بسيار معنادار حقوق و اخلاق كه امروزه در اكثر نظام‌هاي مدرن حقوق اداري تحقق‌يافته، به‌خوبي مشهود است.

The modern principles of administrative law are valuable norms which have been recognized in administrative law of most developed countries. They are used to develop administrative law and materialize an efficient administration which could guarantee basic rights and freedoms of citizens. This paper discusses these principles from the viewpoint of State Services Management Law. This law has been successful in taking advantage of the aforesaid principles and its authors, inspired by those principles, have included such principles as rule of law, equality, impartiality, accountability, transparency, access to administrative information and documents, decorum, obligation for guidance, and giving rapid answers to people. Since Article 90 of this law is the most important of its articles, this and other articles of State Services Management Law have been compared with other laws and regulations. Legal principles have been clearly included in Article 90 while ethical principles have been included indirectly and can be identified in view of their similarities with their counterparts in foreign laws. This article, therefore, has created a meaningful link between law and ethics which has been already realized in most modern systems of administrative law.
