چالش‌هاي تدوين منشور حقوق شهروندي در ايران (با تاكيد بر ماده 100 قانون برنامه چهارم توسعه)

Challenges Facing Formulation of Citizenship Rights Charter in Iran (With Emphasis on Article 100 of the Fourth Economic Development Plan Law)

اين مقاله به آسيب‌شناسي علل عدم تدوين منشور حقوق شهروندي مي‌پردازد و به اين سوال كه «موانع و مشكلات پيش روي دولت براي تدوين منشور حقوق شهروندي و به تصويب رساندن آن توسط نهادهاي ذي‌ربط چيست؟» پاسخ مي‌دهد. براي پاسخ به اين سوال از رهيافت‌هاي «تحليل اجرا» در حوزه مباحث سياست‌گذاري عمومي استفاده شده است. در اين مقاله ضمن طرح مفاهيم شهروندي و حقوق شهروندي در قوانين ايران و قانون برنامه چهارم توسعه، عوامل عدم اجراي ماده 100 قانون برنامه شناسايي گرديده است. اين عوامل شامل: فقدان نظارت موثر بر اجراي قانون برنامه چهارم توسعه كشور (مواد 100 و 130)، فقدان اجماع نظر و توافق در محورهاي منشور و معتبر نبودن مباني و اهداف حقوق شهروندي مي‌باشد

This paper focuses on the reasons which prevent formulation of a charter of citizenship rights in order to answer this question: “What obstacles and problems are facing the government for the formulation of a citizenship rights charter and getting it passed by concerned institutions?” To answer that question the “execution analysis” approach to public policymaking process has been adopted. The paper first explains the concepts of citizenship and citizenship rights in the Iranian laws, including the Fourth Economic Development Plan Law, before expounding various factors which have prevented the implementation of Article 100 of that law. These factors include absence of effective supervision over the implementation of the Fourth Economic Development Plan Law (esp. articles 100 and 130), absence of consensus on the main topics of the charter, and invalidity of the fundaments and goals of citizenship rights.
