شمول قواعد فقه اسلامي در حقوق معلم و متعلم

Comprehensiveness of the teachers’ and students’ rights in Islamic jurisprudence

از زمان تشكيل جوامع اوليه فرايند ياددهی و يادگيری بين معلم و متعلم، حقوق متقابلی را ايجاد نمود كه رعايت آنها منشأ تداوم و تكامل اين فرايند گرديد. در فقه اسلامی نيز توجه بسياری به اين مقوله شده، آيات و روايات فراوانی در اين زمينه دست آويز بسياری از نويسندگان در كتابت اين حقوق متقابل شده است. هدف اين پژوهش، تبيين شمول قواعد فقه اسلامی پيرامون حقوق معلم و متعلم است كه به روش توصيفی، تدوين يافته است. شايان ذكر است كه غالب اين نگارش‌ها بر اساس حقوق و تكاليف معلم و متعلم از ديد اخلاقی تبيين شده، شمول قواعد فقه اسلامی بر اين حقوق در آنها كمرنگ است؛ ولی يافته‌های پژوهش با استناد به هفده قاعده فقهی، اشاره به اين حقوق از منظر قواعد فقه اسلامی دارد.

Since the formation of early societies, the process of teaching and learning between the teacher and student has created reciprocal rights; hence, it was the observing 0f such rights that led to the perfection of this process. This issue, also, has been highly taken into consideration in Islamic and, therefore, many books are written based on the various verses and tradition in this regard.This current study aims to explain the rules of Islamic law on the rights of teachers and students. The method applied is of a descriptive one. It should be noted that most of these writings have been made on the basis of rights and obligations of the teacher and student from ethical perspective, while the inclusion of Islamic jurisprudence has been ignored. However, the research findings refer to these rights from the perspective of Islamic jurisprudence, while considering the seventeen jurisprudence rules.
