بررسي الحاق دولت جمهوري اسلامي ايران به كنوانسيون 1961 لاهه راجع به ضرورت لغو تصديق اسناد عمومي بيگانه

A Review of the Accession of the Islamic Republic of Iran to the Convention Abolishing the Requirement of Legalization for Foreign Public Documents (1961)

از زماني كه روند تاييد و تصديق اسناد داخلي جهت ارايه به دواير خارجي به عنوان يك مسيله مطرح شده است ضرورت بررسي الحاق ايران به «كنوانسيون 1961 لاهه راجع به ضرورت لغو تصديق اسناد عمومي بيگانه» نيز مورد اهتمام جدي قرار گرفته است. شايان ذكر است كه ضرورت وجودي كنوانسيون 1961 لاهه، ناشي از تمايل دولت‌ها به مختصر‌نمودن فرايند تاييد از طريق لغو ضرورت تصديق اسناد عمومي بيگانه توسط نمايندگي‌هاي ديپلماتيك و كنسولي بوده است. با الحاق به اين كنوانسيون، ضرورت مراجعه به نمايندگي‌هاي ديپلماتيك و كنسولي خارجي در كشورها منتفي مي شود. اين امر مي‌تواند خود منبعي درآمدزا براي مرجع يا مراجع صلاحيت‌دار داخلي صادر‌كننده «تاييديه» و مانعي براي نمايندگي‌هاي خارجي جهت كسب درآمد از اتباع ايراني باشد. اين نوشتار ضمن تشريح مطرح شدن روند تاييد و تصديق اسناد داخلي جهت ارايه به دواير خارجي به عنوان يك مسيله، ضرورت بررسي الحاق ايران به كنوانسيون مذكور را بررسي و در پايان، راهكارهايي را به منظور بسترسازي مناسب براي اجراي موثر آن ارايه مي‌دهد.

Since the process of legalizing domestic documents before producing them to the foreign departments has become an issue, serious efforts have been made concerning the necessity of the examination of the Islamic Republic of Iran’s accession to the title Convention. The reason behind the importance of this convention is the willingness of states to shorten the legalizing process through abolishing the requirement of the foreign public documents to be certified by the diplomatic and consular agencies. Accession to this convention makes reference to the foreign consular and diplomatic agencies unnecessary and brings incomes for the competent domestic authorities while barring incomes for foreign agencies. This paper while explaining the certification and legalization of the domestic documents for reference to the foreign departments as an issue seeks to explore the necessity of Iran’s accession to this convention. Finally, it puts forward some solutions to set the scene for its effective implementation.
