جايگاه قانون در تحقّق عدالت حقوقي؛ تامّلي بر نسبت قانون و قاعده حقوقي در نظام حقوقي ايران

The place of law in realization of legal justice A Study of the relationship between law and legal rule in Iranian legal system

ابزار ايجاد قاعده حقوقي دانستن قانون، مي‌تواند به‌معناي پذيرش اراده دولت به‌عنوان مبناي التزام‌آوري قاعده حقوقي بوده، به يكي انگاشتن حقوق و قانون منجر شده، نوعي عدالت دولتي يا مبتني بر اراده دولت و تفسير لفظي از قانون را نتيجه دهد. ابزار بيان يا انتخاب قاعده حقوقي دانستن قانون، به‌معناي رد دولت به‌عنوان منشا قاعده حقوقي بوده، مجال طرح عدالتي متفاوت از عدالت دولتي را فراهم مي‌سازد. عدالت شرعي را روح حاكم بر نظام حقوقي ايران بايد دانست؛ عدالتي كه نتيجه تفكيك قانون و قاعده حقوقي است. عدالت شرعي، نسبت نزديك‌تري با عدالت عرفي داشته و نقش انتخابي دولت در بيان قواعد حاصل از اجتهاد متكثّر، مويّد آن است؛ نقشي كه مانع قضاوت اجتهادي است. البته، گاه دولت با ابزار قانون، ايجاد قاعده حقوقي مي‌كند و اينكه متاثر از نيروهاي مختلف اجتماعي يا بر اساس اصول شرعي قاعده را ايجاد كرده باشد، عهده‌دار عدالت عرفي يا عدالت شرعي است.

The Unification of law and legal rule, represents one of the characters of legal positivism on the basis of the legal rule leading to the unification of law and statute, generating state justice and therefore causing the literal interpretation of the law. Unification of law and legal rule rejects the state as the origin of legal rule giving an opportunity for creating a justice other than state justice. Religious justice id the spirit governing the legal system of Iran, a justice that is the result of separation of law and legal rule. Religious justice has a closer relation with common justice, and the selective role of the state in presenting the rules of pluralistic jurisprudential deduction supports it. A role that prevents from deductive judgment. However, sometimes the state makes legal rules with the help of law.
