شرمساري بازپذيركننده به‌مثابه راهبرد فرهنگي در كنترل جرم

Reintegrative Shaming As a Cultural Strategy for Crime Control

مقاله حاضر، ضمن توصيف و تشريح ابعاد و اركان نظريه شرمساري بازپذيركننده و احصا تفاوت‌هاي آن با نظريات غربي و ذكر برخي از وجوه برتري آن بر نظريات سابق، به دلالت‌هاي عملي و سياستي آن در بعضي از حوزه‌ها از جمله اجتماع، خانواده، مدرسه، پليس و دادگاه مي‌پردازد. با توجه به سيطره نظريه كلاسيك و رويكرد تنبيهي بر نظام عدالت كيفري در ايران، غلبه سياست‌هاي اجتماعي و فرهنگي مبتني بر فرهنگِ فردگرايي و افزايش بيش از پيش نقش دولت و متخصصان حرفه‌اي در اداره امور و نيز تنگ شدن دايره اجتماع و فضاي عمومي به‌طور روزافزون، به نظر مي‌رسد نظريه فوق مي‌تواند به‌عنوان «پادزهري» بر اين جريان غالب عمل كند. در عين حال، تاكيد نظريه مزبور بر مقوله شرم و شرمساري، وجدان اخلاقي، مسيوليت‌پذيري و احياي اجتماع و خانواده و تناسب نسبي آن با فرهنگ ديني و بومي ايران، جذابيت سياسي ـ اجتماعي ويژه‌اي به اين نظريه مي‌بخشد.

This paper, describe and explain the dimensions and elements of Reintegrative Shaming theory and considers the differences between Western ideas and Reintegrative Shaming theory and some aspects of its superiority over previous theories, deals with the practical and policy implications in some areas, including social, family, schools, police and court. According to the domination of classical theory and Retributive approach on the criminal justice system in Iran, domination of social and cultural policies based on individualism culture and increasingly role of government and occupational professionals in public administration, Reintegrative Shaming theory seems to be an "bezoar" to the mainstream. However, the theoryʹs emphasis on shame and shaming, moral conscience, accountability and restoring families and communities, and the relative proportion with indigenous religion and culture of Iran, give this theory political and social attraction.
