كاربرد مفاهيم و اصطلاحات حقوقي در اشعار سعدي شيرازي

معمول است كه هر گاه درباره ارتباط دو شاخه علمي ادبيات و حقوق بحث ميشود، تنها از تاثير و كاربرد ادبيات و قواعد دستوري يا نگارشي آن در زمينه قانون نگاري، افزايش كيفيت ادبي آراي دادگاهها و ساير نوشته هاي حقوقي سخن به ميان آيد. ليكن روي ديگر اين ارتباط يعني نقشي كه حقوق هر ملت در فرهنگ و هنر و ادبيات آن دارد، كمتر مورد توجه بوده است. در ادب پربار فارسي شاعران و نويسندگان نامداري هستند كه اصطلاحات و مسايل متعدد حقوقي را با تمام نكته ها و ظرايف خود، چنان عالمانه و هنرمندانه تشريح و بيان كرده اند كه زبان حقوقي معاصر از تقليد آن عاجز است. با توجه به اينكه شاعران زيادي داراي اين ويژگي هستند و مفاهيم و اصطلاحات حقوقي متعددي در آثارشان مشاهده ميشود، امكان بررسي همه آنها در اين نوشتار ميسر نيست. بنابراين تصميم گرفته شد در اين تحقيق تنها اشعار يكي از شاعران ادب فارسي يعني سعدي شيرازي به صورت استقرايي و از طريق ذكر شواهد، از اين منظر بررسي گردد. حاصل اين جستجو ما را به اين امر رهنمون گرديد كه جلوه هاي حقوقي در آثار سعدي به علل گوناگوني از جمله تحصيلات فقهي وي در نظاميه بغداد نمود زيادي دارد. بدين صورت كه او علاوه بر سخن گفتن از مسايل حقوقي متداول و جاري در جامعه مانند ارث، معامله، ازدواج و امثالهم، از مسايل خاص حقوقي كه غالباً تنها علماي حقوق با آن سر و كار دارند، نيز ياد ميكند و جالبتر آن كه در هر مورد هم از اصطلاحات خاص علم حقوق استفاده ميكند.

It is common that whenever being a discussion about the relationship between the two disciplines of scientific literature and law, just speak from impact and application of literature and its grammar or punctuation in the field Codification, Increase the Literary quality of court’s opinions and other legal writings. But the other part of the relationship i.e. the role that have law of every nation in the culture, art and its literature has been less attention. There are the Famous poets and writers in rich Persian literature who are described and expressed many legal terms and issues with all their points and delicacies as scholarly and artistic that Contemporary legal language is incapable imitating from it. Given that many poets have this feature and several legal concepts and terms can be seen in the works, opportunity may not to review them all in this article. So it was decided in this study, only one lyric poets of Persian literature namely "Saadi Shirazi" from this perspective is be compared the inductive and the aforementioned evidence. The result of this research led us that legal effect in Saadi’s work will be much in variety of cause including his jurisprudence in nizamiyya of Baghdad, He in addition to speak of the Conventional and usual legal issues, such as inheritance, transaction, marriage, etc., speaks from the certain legal issues that often only legal scholars deal them And more interesting that he uses the specific terms of legal science in each case.
