The Backgrounds of the Prohibition of Sexual Offenses in Monotheistic Religions

اديان توحيدي اسلام و يهوديت و نيز مسيحيت از آنجا كه داراي خاستگاه مشترك و منشا واحد هستند، يكساني در بسياري از احكام و قوانين آنها ديده مي شود. ولي اختلاف در احكام و قوانين كتاب مقدس و قرآن كريم بدين علت است كه با توجه به مقتضيات زمان صدور آنها و به هدف تامين نيازهاي معنوي و تنظيم زندگي مخاطبان آن تشريع شده و هر حكمي با زمينه اي خاص، مبتني بر حكمت يا فلسفه اي ويژه است. شباهت هاي بسيار احكام در اسلام و يهوديت از جمله جرم انگاري جرايم جنسي و نحوه تعيين مجازات آنها، در مواردي چون ملاعنه در اسلام و آزمون آب تلخ لعنت در يهوديت، زنا و طلاق در مسيحيت، حرمت ازدواج با محارم و ... بستري مناسب براي تطبيق و مقارنه ميان نظام حقوقي اديان توحيدي است كه در مقاله حاضر مورد پژوهش و بررسي قرار گرفته است.

Since the monotheistic religions of Islam, Judaism as well as Christianity havea common background and origin,some kind of uniformity is observed in most of their precepts and laws.Nonetheless, the differences in the injunctions and laws of the Bible and the Quran are due to thetime requirements, provision of spiritual needs and management of the lives of their followers and every injunction has been issued in a specific context and is based on a particular reason or philosophy. Numerous similarities among the rules of Islamand Judaism including regarding sexual offenses a crime and how to punish the offenders in such cases as mol?eneh (le?n) in Islam and the ordeal of bitter water in Judaism, adultery and divorce in Christianity, and unlawfulness of marriage to close relatives (ma’h?rem), etc. offer asuitable backgroundfor comparison of the legal system ofthe monotheistic religions, which has been undertaken in the present study.
