مقاله حاضر به بررسي و تبيين مباني عدم مشروعيت ضرر معنوي از ديدگاه قرآن و احاديث پرداخته است. به طور كلي در اين مبحث حجيت نهي از ضرر معنوي منطبق بر قرآن و روايات، و اثبات اين موضوع كه دين اسلام علاوه بر جلوگيري و نهي از ضرر مادي، جلوگيري و نهي از خسارت معنوي را مدّ نظر داشته، و مقاومت در برابر اين ضرر را نوعي امتناع از احقاق حق انساني مي‌داند بيان شده است. نهايتاً اگر قانونگذار در قوانين موضوعه به بحث و تحقق و جبران خسارت معنوي پرداخته است عمدتاً بر مبناي دين اسلام يعني قرآن و سنت معصومين(ع) بوده است، و از سوي ديگر نظام حقوقي اسلام كه همواره بر پايه حق و عدل بوده است كوچك‌ترين و حتي ناچيزترين تعدي و ظلم را ناروا دانسته است پس چگونه مي‌توان گفت كه در اين آيين، ضررهاي معنوي بر شخصيت و حيثيت و منش و روح و روان بلند انساني ناديده گرفته شده باشد. بنابراين بديهي است كه روح حاكم بر اين نظام هم در كتاب و هم در سنت به اين مقوله عنايت دارد.
