A Socio-legal and Epistemological Analysis of Jurisprudence

چكيده كار جامعه‌شناسي حقوق بررسي اجتماعي- حقوقي پديدارهاي حقوقي است. رويه قضايي در معناي ويژه آن، شامل انديشه‌ها، قواعد و روش‌هايي است كه دادرسان به‌تدريج و در جريان صدور آراي قضايي ايجاد مي‌كنند و كاركردهاي گوناگوني برحسب جايگاه خود در هر نظام حقوقي و اجتماعي دارد. در اين مقاله، با هدف تحليل نظري و جامعه‌شناختي «رويه قضايي»، جايگاه و اهميت، رويه قضايي در نظام حقوقي و ارتباط آن با منابع ديگر حقوقي را بررسي كرده‌ايم. به كمك نظريه‌هاي جامعه‌شناسي معرفت، نقش خطير رويه قضايي را در نظام حقوقي و معرفت‌هاي حقوقي نشان داده‌ايم و به عنوان نتيجه اين تحقيق، رويه قضايي را مهم‌ترين و ضروري‌ترين عامل كارآمدي و تناسب قواعد حقوقي دانسته‌ايم. كليدواژگان جامعه‌شناسي حقوق، جامعه‌شناسي معرفت، خودتكميل‌گري، معرفت‌حقوقي دادرسانه، نظام حقوقي.

Abstract The sociology of law deals with the socio-legal study on legal phenomena. Jurisprudence, in its specified meaning, includes thoughts, rules and methods and judicial procedures that have been gradually created by judicial interpretations and decisions of judges. In this article, we seek to analyze "jurisprudence" theoretically and sociologically. We examined the status and importance of jurisprudence and its relationship with other legal sources in the framework of legal system. Appealing to theories in the sociology of knowledge, we finally imagined a significant and specified role for jurisprudence in legal system and in relation to other legal sources.
