Criminological Analysis of Economic Crimes

آنچه امروزه به جرم اقتصادي مشهور شده است، متضمن لطمه شديد به نظام اقتصادي هر كشور و نيز نظام اقتصادي بين المللي يعني چرخه توليد، توزيع، حمل و نقل، مصرف و پول اس ت. لذا سازمانهاي بين المللي مانند سازمان ملل متحد و اتحاديه اروپا نيز در دهه اخير در اين خصوص، سياست جنايي افتراقي با گرايش سختگيرانه پيشبيني كردهاند. ازآنجاييكه مصاديقي از اين جرايم مانند پولشويي و جرايم زيستمحيطي جنبه جهاني پيدا كردهاند، به نظر ميرسد كه نظام حقوقي كشورهاي مختلف در پرتو معاهدات بين المللي ازجمله كنوانسيون مريدا، به سمت نوعي همگرايي در پيشگيري و مبارزه با اين گونه بزهكاري گام بر ميدارند. اين رويكرد، چه در ?بعد جرمشناختي و چه در ب?عد كيفري، از چند سال پيش به اين سو، در گفتمان مسيولان قضايي، اجرايي و تقنيني كشور، بهويژه در قانون ارتقا سلامت نظام اداري و مقابله با فساد به دليل تمركز بر پيشگيري وضعي- فني، قانون مجازات اسلامي، به دليل خارجساختن اين جرايم از شمول تعويق، تعليق و مرور زمان و نيز قانون مبارزه با قاچاق كالا و ارز مشهود است. اين مقاله بنا دارد از يكسو به تعريف و مختصات اساسي و از سوي ديگر، به چگونگي پيشگيري از جرايم اقتصادي بپردازد.

What is known today as economic crime involves harm and severe damage to the economic system of each country and the international economic system in the cycle of production, distribution, transportation, consumption and money.So,In the last decade, international organizations like the United Nation and the Union of Europe,have predicted differential criminal policy in light of though penal approach. Different Legal systemsin light of international conventions like United Nations convention against corruption (MERIDA)walk toward such a convergence in the prevention and combat against Economic crime because some kinds of these crimes as money laundering and Environmental Crimes have been known as global offences. This approach in the criminological and in the later criminal aspects is evident In the discourse of judicial, executive and legislative agencies in Iran, particularly in the health bureaucracy and anticorruption due to a focus on situational – technical prevention and Penal Code due to the removal of these crimes from the postponement, suspension. This Resaearch intend to survey the basic coordinates and definition of economic crimes and Analysis the Preventional strategies in this sphere.
