A Comparative Study of the Unemployment Period Protections in Iran and Germany Law

مسيله حمايت از كارگران در ايام بيكاري به دليل داشتن دو جنبه مهم اقتصادي و اجتماعي همواره هم دل‌مشغولي دولت‌ها و هم جزو آرمان‌هاي اصيل سازمان‌هاي حقوق بشري و به‌طور ويژه سازمان بين الملي كار بوده است. مهم‌ترين نوع حمايت‌هاي قابل اعمال در ايام بيكاري، بيمه بيكاري است كه تاريخ آن به زمان بروز اولين پيامدهاي شوم بيكاري در كشورهاي صنعتي باز مي‌گردد. با بررسي تطبيقي مسيله مذكور در دو كشور ايران و آلمان ضمن روشن‌شدن معايب و مزاياي هر دو نظام مشاهده مي‌شود كه تجربه آلمان به عنوان كشوري صنعتي و پيشرو در امر بيمه‌هاي اجتماعي در موارد متعددي براي حقوق ايران در اين زمينه مفيد و قابل بهره‌برداري است (البته با لحاظ تفاوت‌هاي موجود ميان دو كشور). حقوق كار ايران در زمينه بيكاري هنوز يك حقوق نسبتاً نوپاست و بايسته است كه با بهره‌برداري از تجربه موفق كشورهاي ديگر و تمسك به استانداردهاي سازمان بين‌المللي كار، گام‌هاي رو به جلو برداشته شود.

Protecting the labors during the period of unemployment (as unemployment compensation) has important economic and social aspects which make it as the most important concerns of the governments and inter-Governmental organizations especially the international labor organization (ILO). The history of unemployment insurances goes back to the time of negative effects of unemployment in the developed countries. Based on the comparative study of the issue in both countries, Iran and Germany, the advantages and disadvantages will appear. Germany, as an indudtrial and pioneer country, has a good precedent in regard of social insurance, considering the different issues, its experience is useful and applicable for lran law in this area. Iranian labor law, known as an immature field, could take good paces relating to the unemployment period protection via using international standards and experiences of other countries.
