Common ‘Will’ of Parties for Terminating Civil Procedure

يكي از مباحثي كه امروزه ذهن متفكرين حقوق دادرسي را به خود معطوف داشته است، است؛ اين رويكرد با مخيرانه تفسير نمودن مقررات قانون « قراردادي كردن دادگستري » رويكرد آيين دادرسي مدني قايل به افزايش ابتكار عمل اصحاب دعوا، در اين شعبه است. در اين مقاله با عنايت به چنين رويكردي، پايان دادرسي مدني را مورد بحث قرار دهيم. اختتام تواف قي دادرسي » و يا « طرق جايگزين حل اختلاف » اصحاب دعوا مي تواند به وسيله با تراضي يكديگر به دادرسي مدني پايان دهند. در باب قسم دوم « التزام به راي دادگاه » و يا « مدني و خصوصاً قسم سوم كمتر سخن به ميان آمده است؛ در قسم دوم اصحاب دعوا با توافق يكديگر دادرسي مدني را مسترد مي نمايند. در قسم سوم نيز اصحاب دعوا به صورت صريح (و با اسقاط حق خويش در شكايت از راي) و يا ضمني (از طريق توافق در زمينه التزام به نظريه ي كارشناسي) درصدد پايان دادن به دادرسي مدني هستند

These days, one of the topics which has attracted the attention of lawyers is the due process rights, that is, an approach to "deal out justice". This approach enables parties to interpret provisions of the Civil Procedure Code. In other words, it provides parties with an initiative in this area of law. This article .ng on this approachdiscusses the end of civil procedure by focusi. Parties can end the civil procedure by proposing an alternative means of dispute resolution, by terminating the agreement on civil proceedings or by complying with the court’s judgment. There has been less literature and debate on the second and third methods of ending the civil procedure. In the second method, parties agree to withdraw their civil dispute(s). In the third method, parties end the civil procedure either expressly by waiving the right of appealing the judgment or impliedly by agreeing to abide by expert opinion.
