A Comparative Study of Concept and Kinds of Disputes among Different Persons

تعدد اصحاب يك دعوا وقتي محقق ميشود كه يا هر كدام از آن‌ها مدعي نفع مستقلي در موضوع دادرسي باشد يا اين‌كه خواهانها و خواندگان متعدد با منافع مشترك دعوايي را مطرح يا از آن دفاع كنند. كاربرد اصطلاح «راي غير قابل تجزيه و تفكيك» ناظر به دعواي بين خواهان‌ها و خواندگان داراي نفع مشترك است. «دعواي غير قابل تجزيه و تفكيك» از مصاديق دعواي بين اشخاص با نفع مشترك است، ولي اين خصيصه فقط بين خواندگان وجود دارد و در اين نوع دعوا بايد همه خواندگان طرف دعوا قرار گيرند. ماده 74 قانون آييندادرسيمدني ناظر به «دعاوي غير قابل تجزيه و تفكيك» است. در اين مقاله به بررسي تطبيقي مفهوم و انواع دعاوي بين اشخاص مختلف پرداخته مي‌شود. وضعيت فعلي و مطلوب حقوق كشورمان درخصوص اين موضوع نيز تشريح خواهد شد

Dispute among different persons is conducted when either every one of them allege independent interest in proceeding subject, or when numerous plaintiffs and defendants having common interest allege or defend action. Phrase “Inseparable judgment” includes dispute among the plaintiffs and defendants having common interest. “Indispensable claim” is a kind of dispute among the persons having common interest; but there is only this relation among the defendants. Because in this kind of dispute, all of the defendants must be complained. Article 74 of Civil Procedure is observer on inseparable claim. This paper discusses the concept and kinds of disputes among different persons from a comparative aspect. The approach of Iranian civil procedure in this matter is considered as an important subject that needs to be discussed by adopting convenience rules from foreign law.
