چكيده فارسي :
هدف از اين پژوهش بررسي رويكردها و برنامه‌هاي عدالت ترميمي در مقابله با جرايم ناشي از نفرت است. بسياري از پژوهشگران حوزه جرم‌شناسي و عدالت ترميمي، بر اين باورند كه برخي از جرايم جدي و سنگين، مانند جرايم ناشي از نفرت، جرايم سازمان‌يافته، تجاوز به‌عنف و ...، فراتر از ظرفيت‌هاي بالقوه و بالفعل عدالت ترميمي است و عدالت ترميمي تنها در جرايم خرد و با درجه اهميت متوسط و پايين، قادر به حل و فصل جرايم است. مسيله اين است كه، آيا رويكردهاي عدالت ترميمي تنها در جرايم سبك و كم‌اهميت قابليت حل و فصل دعاوي را دارد؟
در پاسخ به اين سوال، اين فرض مطرح مي‌شود كه رويكردهاي عدالت ترميمي، قادر به مقابله با بسياري از جرايم خطرناك و جدي هستند. اهميت و ضرورت اين بحث از آنجا آغاز مي‌شود كه امروزه در بسياري از جرايم مهم، مانند جرايم ناشي از نفرت و يا جرايمي نظير آدم‌ربايي، رويكردهاي كيفري و بازدارنده پليسي، به‌تنهايي قادر به حل مشكلات نيست و قانونگذاران ناچار هستند تا از رويكردهاي خشك قانوني فاصله گرفته و هرچه بيشتر، با رويكردهاي پيراحقوقي و پيراقانوني نظير مذاكرات صلح، به مقابله با جرم و انحراف برخيزند.
با توجه به برخي از پژوهش‌هاي صورت‌گرفته در اين حوزه و همچنين دستاوردهاي آن در زمينه مقابله با جرايم مهمي مانند جرايم ناشي از نفرت، تجاوز به‌عنف و ...، نگارنده به اين نتيجه دست مي‌يابد كه از طريق رويكردهاي حاصل از آموزه‌هاي عدالت ترميمي، مي‌توان به مقابله با اين جرايم نيز برخواست. همچنان كه برخي پژوهش‌هاي صورت‌گرفته در اين زمينه كه به آنها خواهيم پرداخت، اين امر را اثبات كرده است. اين پژوهش به‌لحاظ روش تحقيق، به‌صورت توصيفي- تحليلي و به‌لحاظ روش گردآوري اطلاعات، به‌شيوه كتابخانه‌اي صورت گرفته است.
