بررسي مقايسه‌اي تاثير قصد بر مشروعيت عمل؛ نزد فقيهان اصولي و فيلسوفان تحليلي

A Comparative Study of the Effect of Intention on the Legitimacy of an Action _ In Usul and Analytic Philosophy

در اين مقاله، نخست با تبيين نظريه تاثير قصد بر مشروعيت عمل (DDE) و شرح محدوده دقيق ادّعاي آن، در ادامه ادلّه مخالفان اين نظريه در قالب پنج دسته دليل ارايه مي‌گردد. سپس پاسخ و ادلّه طرفداران DDE بيان مي‌شود كه ضمن ردّ استدلال‌هاي طرف مقابل، شواهدي براي تثبيت ادّعاي خويش عرضه داشته‌اند. نگارنده با ارزيابي آراي دو گروه، به اين جمع‌بندي مي‌رسد كه دلايل مخالفان DDE، آن اندازه قوّت ندارد كه بتواند ادّعاي شهودي اين نظريه را زير سوال ببرد و تلاش‌هاي ايشان براي ارايه تبيين‌هاي متفاوت، چندان موفّق به نظر نمي‌رسد. در بخش پاياني مقاله نيز يك نوع بررسي مقايسه‌اي با آراي فقيهان اصولي درباره اصل تاثير قصد بر مشروعيت عمل انجام گرفته است كه نشان مي‌دهد بيشتر ايشان با چنين اصلي موافق بوده‌اند. نيز در ادامه، بحث «تجرّي» در اصول فقه مطرح شده است كه منشا مناقشه‌هاي گسترده در باب تاثير قصد بد فاعل بر نامشروع‌شدن فعل بوده است. نگارنده با ذكر ادلّه هر دو گروه در اين مسيله، سرانجام به اين نتيجه مي‌رسد كه استدلال موافقانِ تاثير قصد فاعل بر عدم مشروعيت تجرّي قوي‌تر مي‌باشد.

A Comparative Study of the Effect of Intention on the Legitimacy of an Action _ In Usul and Analytic Philosophy In this paper, I will first explicate the doctrine of double effect (DDE) _ the effect of intentions on the legitimacy of an action _ and then present the arguments provided by opponents of DDE. I will then examine the replies by proponents of DDE, together with evidence they have provided for their theories. I evaluate the views of the both sides, and seek to show that the arguments provided by the opponents of DDE are not cogent enough to undermine the intuitive appeal of DDE. Finally, I will compare this issue with views in Usul al-fiqh (principles of the Islamic jurisprudence) regarding the effect of intention on the legitimacy of an action _ I suggest that they seem sympathetic to a principle like DDE. I also discuss the problem of effrontery (tajarri) in Usul al-fiqh that has led to controversies over the effect of an agentʹs bad intentions on the illegitimacy of his action.
