Jurisprudential Effects of the Theory of Hermeneutics Based on Imam Khomeini’s Approach

گرايشات تفسيري متعدد تا حدود زيادي وابسته به اوضاع و احوال انديشه‌هاي حاكم زمانه بوده و روش تفسيري برتر، در بستر زمان جايگاه خود را پيدا مي‌كند؛ آنگونه كه امروزه روش تفسير قرآن به قرآن و شيوه هاي تاويلي و مقاصدي، با اقبال بيشتري مواجه هستند. به نظر نگارنده شناسايي مقاصد اصلي شارع، اساسي ترين نكته جهت تفسير و تاويل صحيح است. اهم دلايل كم اقبالي تفاسير روايي، عدم توجه به مقاصد قرآن است. در حالي كه اين امر مورد تاكيد امام خميني است؛ اما اينكه تا كجا مي توان با اين رويكرد به تاويل پرداخت، و آيا مي‌توان در جهت استنباط فقهي نيز دست به تاويل زد، امري است كه محل تامل محققان مي‌باشد. به نظر، سيره عملي امام‌خميني مي‌تواند مبناي طرح چنين مطالبي باشد. در اين تحقيق شواهدي در خصوص امكان تاويلات فقهي و اجتهاد مقاصدي ارايه مي‌شود.

Diversified interpretive tendencies to a great deal depend upon the conditions and dominant thought of the time, where the best method of hermeneutics finds its deserving place. Today, Quran by Quran interpretation as well as hermeneutic and teleological methods are more common. The author of this paper is of the opinion that identifying the ultimate goal of the legislator is the most essential point in correct interpretation and hermeneutics. Inattention to the ultimate goals of Quran is one of the important reasons behind unpopularity of narrative interpretation, while it has received emphasis from Imam Khomeini. But it is upon the discretion of the researchers to find how far this approach can be used for interpretation and whether theory of interpretation can be also used for jurisdictional inference. Apparently, Imam Khomeini’s practical conduct can be the basis for presentation of such discussions. In this paper we will present evidences for jurisdictional interpretations and teleological Ijtihad (independent reasoning).
