Study of effects of Imam Khomeini’s opinions in principles of jurisprudence on his political jurisprudence

اندیشه هر متفكر مبتنی بر مبانی وی از جمله مبانی روش شناختی است. اصول فقه به‌عنوان روش تحقیق فقه به طور عام و فقه سیاسی به طور خاص، كلید فهم مبانی یك فقیه در عرصه فقه سیاسی است.با منقح شدن مبانی، شیوه‌ها و آراء خاص اصولی یك فقیه و رابطه آن با فتاوای وی در فقه سیاسی،  نه تنها می‌توان به فهم مبانی و ریشه‌های نظریات وی در فقه سیاسی دست یافت، كه می‌توان در مواردی كه فقیه در رابطه با موضوعی، نظری ارائه نكرده است، با توجه به مبانی، شیوه‌ها و نظرات اصولی او، نظر وی را در رابطه با آن موضوع خاص كشف كرد. یكی از مهمترین بخش‌ها برای بررسی رابطه اصول فقه و فقه سیاسی یك فقیه، بررسی نظرات و آراء خاص اصولی وی است. بدین منظور در این مقاله به بررسی هفت نظر از نظرات مؤثر امام خمینی(ره) در اصول فقه و تأثیرات آن بر فقه سیاسی ایشان می‌پردازیم تا به این سؤال پاسخ دهیم كه آراء خاص اصولی ایشان چه تأثیراتی بر فقه سیاسی ایشان داشته است. برای انجام این تحقیق به فحص از آراء خاص اصولی امام خمینی(ره) از یك­سو و تدقیق در فتاوای ایشان در حوزه فقه سیاسی از سوی دیگر پرداخته ایم تا ارتباط میان آراء خاص اصولی ایشان با فتاوای ایشان در فقه سیاسی مبین شود.

The thoughts of any thinker are based on his tenets such as his methodological tenets. The principles of jurisprudence as the methods of researching jurisprudence in general and political jurisprudence in particular are the key to understanding a jurisprudent’s tenets in political jurisprudence’s field.   By clarifying tenets, methods, and particular opinions in principles of jurisprudence and their relations with his political jurisprudence, not only, we can understand the tenets and origins of that jurisprudent’ thoughts in political jurisprudence, but by regarding his tenets, methods, and opinions we can also find out about his opinions in cases that he hasn’t presented any opinions.   One of the most important parts in understanding the relations between a jurisprudent’s principles of jurisprudence and his political jurisprudence, is studying his special opinions and verdicts in principles of jurisprudence.   Therefore, in this article we study seven opinions of Imam Khomeini out of his most effective opinions in principles of jurisprudence and their effects on his political jurisprudence in order to answer this question: what effects his particular opinions in principles of jurisprudence has had on his political jurisprudence?   In order to do this research, we searched about Imam Khomeini’s particular opinions in principles of jurisprudence on the one hand, and paid attention to his verdicts in political jurisprudence field on the other hand to clarify the relationship between his particular opinions in principles of jurisprudence and his verdicts in political jurisprudence.
