Analyzing the law controlling International Relations with and Emphasis on a security Perspective of Early Islamic Period

زمينه و هدف: علي رغم اظهارات گوناگون پيرامون خاستگاه روابط بين المللي دولت ها، مي توان گفت اسلام قواعدي را براي تنظيم قراردادهاي بين المللي با امعان نظر به اهداف امنيتي مورد نظر در اينگونه روابط، تاسيس نموده است. هدف اين مقاله تشريح و بازشناسي مفاهيم قراردادهاي بين المللي به عنوان قانون حاكم بر روابط بين الملل در اسلام با ديدگاه هاي امنيتي و نشان دادن ژرفاي نظر اين مكتب به عنوان كاملترين مكتب ديني الهي در تنظيم روابط بين المللي دولت ها و توجه به مسايل پيراموني تاثيرگذار بر اين روابط مي باشد. روش: مقاله حاضر اسنادي و از نوع توصيفي تحليلي ميباشد كه مطالب آن به طريق كتابخانهاي و فيشبرداري از منابع مرتبط جمعآوري شده است. يافتهها: بررسي اسناد موجود بيانگر اين موضوع است كه روابط بين المللي در اسلام در ابتدا به شكل تشكيلات بين القبايلي ، اعطاي مصونيتهاي ديپلماتيك (و ان احد من المشركين استجارك فاجره حتي يسمع كلام الله ثم ابلغه مامنه) (توبه، 6) و ايجاد روابط در قالب قرارداد امنيت در تردد و جواز ورود به بلاد اسلامي (استيمان) و يا صلح با مضموني سياسي (نه در امور مالي و اقتصادي) و... بوده است كه همگي نشانگر پيشتاز بودن در زمينه ي ايجاد روابط ديپلماتيك همچنين توجه به نكات امنيتي در اين روابط ميباشد. نتيجهگيري: توجه به خاستگاه قوايد حاكم بر روابط بين المللي جامعه اسلامي مي تواند بيانگر قدمت، دقت و فراست شارع مقدس در تدوين و تنظيم روابط، به ويژه در عرصه بين المللي در اشكال مختلف (از اعطاي مصونيت موقت تا ترك مخاصمه) باشد كه معيارهاي امنيتي بي نظيري را بر آنان حاكم، تا اساسي ترين اين اصول (كه از برتري دين والاي اسلام و مسلمانان حمايت و حفاظت مي نمايد) مورد تعرض قرار نگرفته و ارزش هاي اسلامي از دستاندازي بيگانگان مصون بماند.

Context and objective: In spite of the wide range of statements about the wide range of statements about the origins of international relations of the governments, it can be said that Islam has set some rules and regulations to establish international treaties, and in this Islamic Endeavour is embedded a subtlety regarding the security aims of these relations . This article tries to rediscover and expand the concepts of International treaties as the law controlling the international relations in Islam with security viewpoints, and aim is, first, to highlight the erudition underlying this schoolʹs ideas, as the most complete religion, in setting the governmentʹs international relations and ,also, to shed some lights on the other factors which are effective on these relations . Methodology: This documental article is descriptive-analytic and its data are accumulated in a library-based way through taking notes . Findings: The analysis of the available documents indicates that we can trace the roots of international relations back to the early Islamic period in which these relations can be digged out of different guises such as: among-tribe regulations (according to them the tribes of Mecca were in charge of providing all the other visiting tribes and people with their rights and security) (Zanjani, 10:1388), diplomatic immunities )و ان احد ندا اكينداس اجدرك فاج هدفتي ي دع كلامدر ثم اب غ ا مند ندف ن د ( (penitence, 6), and setting relations under the guise of the security-of-traffic treaty and the license to enter Islamic countries (stiman) or political reconciliation (not economic one) (Heli, 113: 1389), and etc. All these is a sing of being the pioneer in establishing diplomatic relations and ,also, considering security factors in these relations .
